Caught speeding

  • On the bright side, once the ban is enforced any other points, including speeding offences, will be taken off the licence.

on top of this you need to factor in the extra amount it will cost you on your insurance for the 5 years.
  • Significant Ban ( around a year) I reckon, Significant Fine (1k minimum depending on his income) and if he acts in a manner other than apologetic and remorseful possibly extended test resit. Would also imagine 6 points too.

Your OH should plead guilty immediately. Be extrememly apologetic and remorseful. state that the roads were quiet etc to mitigate the offence but ensure its seen as mitigation and not excuse making. Dont even mention that the officer thought it was "good" driving except the speeding.

If your OH winds up a magistate the above could all easily double.

Do not try and get out of it using pepipoo as if you do and fail you will be hammered silly.

Not sure if this is true, I thought they stay on for 4 years

Get out of it? The suggestion to go to pepipoo was for some practical advice, not to "get out of it". Because practical advice is usually thin on the ground on MSE in situations such as this.

    6 months ban
At LEAST £500 fine (probably more).

Anything over 100mph is usually automatic ban for 3 months but seeing as how this was blatant speeding and not a few mph over, the 6 months is VERY likely.

It will be points or a ban - not both. Most likely to be a ban in this case though.

In my youth I was caught doing 107 on the A1M. That resulted in a 28 day ban and £350 fine. Was last century though :)

They have 6 months to issue the court summons from date of offence providing you received notification. The officer stopping your other half counts as the notification. In my case the summons arrived 5 months and 3 weeks after the event.

On a practical note, I cancelled all my work holidays and saved them up to cover the ban. My employer at the time was very accomodating in that respect.

I would be expecting a ban in the region of 6 to 12 months and a hefty fine, he was nearly double the speed limit and travelling at a speed that was considerably dangerous not only to himself but other road users, magistrates always make a big song and dance about safety issues like that, then usually have a few sherry's before hoping in the Jaaag and driving themselves home drunk as a skunk......;)

I think any punishment will depend on how good his solicitor is. My OH works for a legal expenses insurance company - loads of these types of cases come up and some people have had extremely lenient punishments.

    Thank you everyone.

We understand that a ban is inevitable and we have posted on the MCN forum which is for Bike owners they have also said a ban is inevitable they have said around 3 months is normal not sure if bike bans are diff to cars as they seemed to think this was average. He is remorseful and i must point out he doesnt normally ride like a bat out of hell im not sure what quite came over him.

I have also pointed out that his insurance will rocket and he will have to attend what they call a speed awareness course. If the insurance does go to high he will have to get rid of the bike no two ways about it we cant afford to finance his stupid mistakes.

I think a word with a solicitor is required so that will be our next stop once we receive the summons and know what he is up against :-)

Now i am of the opinion that no matter what happens he will loose his licence Hopefully for a few weeks but more probably for about 3 months. Its a first offence and has a completely clean licence. He has accepted he has done wrong and been completely stupid and is not trying to get out of it in anyway shape or form. we just wanted some opinions on what he can expect by way of punishment!

I think the problem with a magistrate is that they are going to know it isn't a first offence, it's just the first time he has been caught. I would imagine you are just glad he has lived to tell the tale.
