  • As he was the managing director when some of the deposits were never paid into the approved schemes is he liable or the company he ran at the time? Possibly some one or a group of us have to take the company to court and apply for it to be liquidated?

    I had a deposit taken on the 5th of April 2007 for over £500.

    Been in contact with my landlord but he is not particularly being any help. Ultimately is he liable for my deposit?

    ANy help would be great or if someone could point me towards a useful webby.

    Yes, landlords are ultimately responsible for the return of deposits - agents are mere intermediaries and are irrelevant in the legal relationship that exists between tenants and landlords which is always the primary one - agents represent landlords (not replace them). The best way I've heard this described is that agents are a transparent window through to the landlord.

    You can get confirmation of your landlord's obligation to return your deposit, even when the agent squanders it, on the rental forum of landlordzone which has housing solicitors as members, or by contacting Shelter. The Shelter website has excellent info on how to deal with landlords who haven't protected the deposits (even when this is due to the negligence of an agency).
  • I have been trying to trace Brendan Taylor for some time. I have only just found this thread so am a little behind the pace here. He owes me money in connection with a property I was renting out in Wolverhapmton.

    Can anyone update me on what the latest situation is?

    Does anyone know where Taylor is, does anyone have a phone number for either Taylor or Donna voice?
  • i know were he lives and cant beleive nothing is being done to him,hes walking around wolverhampton as if nothings happened,he lives in the fallings park area and drinks in the new pear tree.im so angry that hes getting away with this weres the police or the trading standards why arnt they getting this criminal.
  • i have let a property through moorfoot estates agents but now that i have vacate it and went to request my deposit money i was informed that they did not put it in the dps scheme.. could anyone give me some advise on what to do cause their office has close down and i dont know where to start to take action against them

    hi does any one have an update for this???
    i was contacted by trading standards in wolverhampton in october and gave a statement.they were collecting more statements at the time to take him to court ,so far i have heard nothing from them.i would like my tenants deposit back that i had to refund them, so im wondering whether to take brendan or donna to court.but have no address as last time i spoke to donna at her house she was putting it up for sale and moving to her parents.

    I would assume that you would take the company to court since landlords contracts tend to be with a limited company and that you would use the address given with Companies House as the service address - who did you sign your contract with?

    how do i find out any addresses .the office has gone and the director donna voice has moved address.i need to give an address for money claim online for them to send court action to.

    Take expert advice but my understanding is that in a contractual matter a person takes the company to court.

    But realistically, what can you get out of a company that has ceased trading, has no assets, etc? Are you hoping to make the company insolvant?

    The following info also reminds the claimant that a limited company may have no assets so as a claimant, you could get a judgement but not be able to enforce it.

    "it may be difficult to enforce a judgment against a limited company as you can only claim against assets owned directly by the company itself."

    Their registered address is presumably the one given to companies house? I assume you serve the documents to the one listed on the Companies House website - use the webcheck service to find it.
