Nemo PPI Claims?

    We got the recordings today, which they believe will be to our satisfaction, but, a couple of things:
    There seem to be a couple of recordings missing! We only received a total of 4. 2 per loan, which was one to each of us per loan. However, we recall at leat a couple of others, so where are they?

    Secondly, the word "recommend" is in abundance, especially for the first loan. And when I tell him that the repayents would then be more than budgetted, he simply recalculates the loan to a longer term to bring the payments down! I also query that this will delay things as time was now critical but I am promised that he will ensure that it doesn't slow anything down... no mention of "optional" or that "recommend" could also mean we could take this out with someone else.

    Maybe we were a bit naive, but we definitely feel that we were railroaded!

    Anyway, I won't bore you with the other details of our findings/feelings from the recordings other than we will still be persuing the matter once we have listened again a couple of times and composed a suitable response.

    This was the problem with our recorded calls as well, I could even remember the questions I asked them on the phone when the sale was going through of the loan and they were not on there, on that particular day of when it was sorted, they did accidentally leave some on there though, luckily it helped our case with the FOS.

    Yes listen to them all right through, you should notice dates, times as well, if you also have any paperwork from a SAR, for example, transcripts of telephone calls, see if you can match them up, and if this did go to the FOS, make them aware of the missing calls as well, I'm sure they will figure this out.

    Ref. the missing calls, we are certain that there are at least 2 missing, which were regarding the survey I told you about. This was why I can be heard complaining about more delays with processing the application on one of the recordings. We remember discussing the need for the survey as well as a post survey call as well as chasing them up for a copy of the survey, which they tried to hold back on. Although these may not strictly be sales calls, surely they are relevant as it ultimately affected the application(s).

    Actually the recordings are really quite clear, which I was a bit surprised about. However, there are no references to the dates or times that the calls were made/received on the disc. Could this be a problem?

    With mine I put it into the computer and came up was a list of dates, months and times, I would ask for this type of disc to be posted to you otherwise.
    What type of disc is it?

    Remember though the FOS, you let them know this as well, as you have explained in your above post.;)

    The only information on each of the files is exactly the same date and time details: 01/01/2005 01:00.

    It is a standard CD-R.

    Looks like I'll be going back to them to ask for another disc, this time with the relevant information! I'd have thought that they would know that we'd want this information?

    It's just like Martin Lewis said in a magazine interview last week. He stressed how these companies will seriously try your patience in the hope that you'll eventually give up.

    So, another letter goes in the post.....

    I'll keep you updated acordingly.

    Just tell them that the one you have is not compatible, and for them to send a suitable one for your requirements.

    i am going through this process. i have got upto nemo sending me a letter saying that they refuse all claims and they have sent signed copies of our agreements. what do i do know? do i
    a) request recordings
    b) cancel my insurance and ask for a re calculation of my loan?

    can you please advice me what to do next.
    when me and my partner were going to apply for the loan, we were in a very tight situation meaning that we really needed the money as far as i can remember- i did agree to everything they said dur to circumstances & desperation. will this affect my claim?
    please advice accordingly . thanks. your help is appreciated in this matter. ashzar

    With my experience of Nemo they are not the easiest but keep at them, mine was finally resolved through the FOS, so if you decide to go this direction after receiving a final decision I'm sure the FOS will look into this for you.

    Was it Nemo that actually sold you the loan or a broker, if its nemo then you done with right thing by writing to them, of if it was a broker you would have to write to them, I take it though yours was sold directly by nemo?

    It is a good idea to request they send you the copy of the recordings, write a letter to request for them and enclose the account number details.
    Also just to make you aware that after the cooling period of 30 days, they will cancel or should cancel if you request this but the repayments will not drop by much, but if your successful, remember you will receive a refund of all the PPI you have paid etc.

    You may have many reasons for why this was mis sold, Nemo with my experience they did not give us any choice anyway, I did with the first loan we had from them thought it was all part of the loan, then learnt not so long after that this should have been optional.

    Being sold these single policies alone is a complaint in itself an very costly, I bet they did not make you aware that the ppi would only last 5 years, where you would be paying out the ppi for the life of the loan, so if your loan was for say 20 or 25 years then you would still be paying out on the PPI then for nothing.

    I would also include that in your complaint if this does occur to you and this type of policy is frowned upon and am aware banned now.

    So you have already wrote to them to reclaim then?

    If so and they have not given you the final decision, write back and ask them to reconsider, and add anything else in further information to help your case.
    The final decision from them should enclose details of the financial ombudsman service (FOS) you can take your complaint to them if your not happy with the final outcome.

    I have just written to Nemo again to request another disc with proper time/date stamped recordings. I've also advised them that a couple of recordings are missing.

    On a seperate note, 2 things have struck me...
    On the recordings they repeatedly "recommend" the PPI because we have insufficient cover. Not once is the fact that it is optional ever mentioned, or that we could get an equivalent policy elsewhere.
    Additionally, the policie were/are only valid for 5 years, but the loan is for 20 years! Hardly an appropriate product, surely?

    I also have a new question... We originally applied on line for a loan with Capital One, which was subsequently provided by Nemo. Nemo are now advising that Capital One were the "broker", who I now know also arranged the initial property survey that we had. Does Capital One therefore have any liability for any of this? Just a thought.

    Yes that is what we were told as well and heard on the disc, this should also help your case, because you should have also been told, even though it is recommended that you should be protected, they should have made you aware this was still optional, and it could have been that you wanted to purchases a stand alone cover anyway.

    Yes hun, as the broker arranged the loan, its apparently them you write to.

    Please remind me, though to save me going through the posts again, did you have 2 loans with nemo, where the first one was arranged with Cap one and the 2nd a loan advance?
