    Where the camera van is parked is not relevant in this case. However, before you do anything, get on to pepipoo.com for some proper advice. Make sure the ticket's correct and all that.

    It's human nature to try and get out of everything that we manage to get ourselves into! I don't think there's too many people who wouldn't try and get out of getting points for a few miles over the speed limit.

    How far you go with it... Now that's another matter!

    40 in a 30 mph limit isn't a " few " miles over though is it?;)
  • The police have an exemption to park wherever they like in carrying out their duties.

    Except private land. But that still wouldn't negate the evidence collected.

    Easy solution. Get on your bike, cycle down the cycle lane when said vehicle is present. Fall off bike, and acquire numerous injuries. Then sue them!

    I was filmed by a camera doing 50 in a 30. The van was concealed and was in breach of the rules about distance etc. I emailed the chief constable in charge of the mobile camera unit about the position of the van, he replied stating that I was correct re the breaches and they have now resited it to the other side of the road where they sit reguarly.
    However, regardless of where the van was sitting, I broke the limit and therefore the law, because of the speed involved it went to court, where I pleaded guilty and was given a £120 fine and 3 points. People need to take responsibility for their actions and stop looking for loopholes IMAO

    its like the ANPR vans, they regularly sit half on the hard shoulder half on the grass verge of the M8 in glasgow they are unmarked vans and dont even have beacons or highway maintnenance stickers on then,but they are allowed to sit there videoing everyone passing.
    im sure if you tried that you would end up having your car towed away.

    You would if you don't have a good reason for being there. They are involved in catching people breaking the law. That's why they can sit there!

    For what it's worth a lot of Traffic Orders will have an exemption for these things. I could do similar when I was working on roads.

    Agreed, the law, even if some people do not agree with it, is there to protect each and every one of us.

    Anybody driving at 40MPH in a 30 limit is a clear danger to others.

    If you are sure that the van was stopped and causing an obstruction then you could request a court appearence. Request the disclosure document, scrutinise all the document carefully to ensure they do conform to the relevent legislation. BUT you need to research the highway properly, is the cycle lane part of the highway? Only seperated by a white line (not a solid barrier) and how is the cycle lane designated, or was it. For instance some bus lanes in London are designated by the local council not TfL, and some do not allow emergency vehicles to use them and if they do they will be issued with a penalty notice as they are not exempt!

    Worth checking as you might get off, BUT you might not and it does require some legal work yourself. Don't believe everything on the internet, magistrates are real people making real orders......They don't often read these forums, and will be guided by the clerk of the court not a website!
    These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

    I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!
