Daughters had an Accident on Friends Trampoline!!! Now What???

so if your daughter fell off a trampoline in your own garden, would your parents be encouraging her to sue you, or what if it had occurred on their property, would they still be suggesting the same thing?

Thats what I think as well tbh but my parents are now saying that if I don"t sue they will!!! Its an awful situation to be in. I don"t want to end up taking legal action against my friend even though I can see my parents point of view and that they are worried about the long term consequences of this for my daughter. Yes my friend should have been watching the children but it was an accident!!!! I"m really stuck..

I agree with the others, it was an accident and your friend probably feels badly enough without everyone blaming her. Its sad that your little one was badly hurt but hopefully she will recover and be good as new eventually.. its a difficult situation but how is sueing your kindly friend actually going to make a difference to your daughters situation? So you will get some money out of it but is it worth losing a friend over?
If you aren't comfortable with it then don't do it... I hope your daugter recovers soon#6 of the SKI-ers Club :j

Thanks for all the replies everyone, I think I will tell my parents that if they want to sue my friend then they will have to go ahead and do it without my involvement. Fair enough my daughter has been injured but my friend is a good friend and I don"t want to fall out with her when she was doing me a favour in the first place and it was an accident. Tell your parents to go ahead and sue - when they do though you will be happy to act as a witness for her and say she was doing a favour for you and you as the parent have no intention of seeking compensation from her and that you don't support their claim - explain to them that it will do nothing but waste their money!

I was bitten on the face by a dog when I was a child and was told there would be scarring (round my right eye... it missed my eye by half an inch...) however 6 months later the last scar faded enough that you'd never know it was there

I tend towards the accidents are accidents point of view, however if once all the treatment has taken place there are long term implications which might mean your daughter requires additional treatment, or she has long term changes in the usefulness of her arm, then at that point you can calmly consider whether a claim for compensation should be made. If that does arise, then by that time most of the emotion will be taken out of it and you will be much more likely to be able to take action which is seen as taking advantage of the insurance to help your daughter rather than as having a go at your friend.
With a 3 year old you have a long time to make a claim for compensation as if I recall correctly the limitations don't start to run until she is 18. Concentrate for the time being on getting her well, and if you need to consider compensation then do it in a calm atmosphere once you know the facts. You will in any event get very little just for pain etc, most of the bigger claims come from loss of earnings or requirements for carers etc. Taking a claim is also not to be done lightly as she will have to undergo all sorts of additional medical examinations by expert witnesses to produce reports explaining the damage.Adventure before Dementia!0
