I think that geri1965 has put a helpful link above. If there is no fault, there is no liability and therefore no claim. It all depends on how strong the case was, and how much the insurance company would defend it.
But now there has been this discussion, I wonder how much that will influence the insurance company who will no doubt be monitoring the forum!!
On the other hand, if you have an accident and that is covered by insurance (yours or someone elses) why would you NOT claim? It is not personal, just following through the terms of that insurance. I grazed a neighbour's car in the drive once, my fault and I paid myself to avoid damaging no claims. I still speak to the neigbour.
So it is down to who is liable or if it were just an accident?
So claim and split the cash 80 20.

I hope your little girl is feeling better.
When my friend's son broke his wrist and had an open fracture [bone sticking out type] of the elbow he made a full recovery after many months of NHS treatment. He had a couple of operations and wore guide wires on a frame from his fingernails back up his arm. It was very nasty at the time and his Mum and Dad had been given the worst possible scenario by the doctors. But that is what they have to tell you. Expect the worst and hope for the best.
My friend's boy has made a complete recovery, regaining all the movement and feeling in his arm.

. I broke my arm over 40 years ago when I was 4. After it had healed I've never had a moments problem with it.
The grandparents seem to be more of a hindrance than a help. You can do without the added stress. Take care of yourself so that you can take care of your little girl.

See if your friend has any insurance cover for public liability.
Then make a claim.
Alternatively see if an ambulance chaser is prepared to deal with it for you. Might cause less offence than your parents sticking their oar in!0 -
Yeah, well she"s fast asleep in bed at the moment, the minute she wakes up I"ll stop posting. In fact I"m going to stop doing so right now because I wanted a bit of help and support this morning not to be reduced to tears by some of the comments I"ve had and accused of just being after my friends money. I thought I might get some support on here but obviously I was badly mistaken and for the posters who have accused me of being after my friends money I think you ought to take a long hard look at yourselves because I have never said that I wanted to sue my friend or that I wanted her money. That is an assumption you have made and to accuse me of using my parents as an excuse is also an awful thing to do because I have absolutely no reason to lie about what has happened. Why would I want to fall out with someone who has been a good friend to me in the past anyway??? I know I"m a bit stupid but I"m not that stupid. Accidents happen - blimey if my parents had sued every time I fell out of my grandfather's apple tree, or the time I fell off the slide in the park, or when I fell off the trampoline at school - they would be very rich now but they didnt because accidents that kids have are part of growing up.
It is unfortunate that your daughter fell off the trampoline but a) she shouldnt have climbed onto it herself and b) your husband shouldn't have left her with your friend - so if your parents are considering sueing anybody it should be your husband for leaving your daughter in a place where she fell and broke her arm. There is no need to sue anybody - it was an accident and as someone else has said those in the medical profession will always give the worst case scenario so that you are prepared for any eventualities. A 3 year old will soon bounce back - her bones are still growing.0 -
Accidents happen , especially on trampolines , I havent read all the posts but your first post doesnt say where your friend was at the time ? ............not that it makes any difference to my view that you shouldnt sue .
I have 4 kids 3 of them have broken 2 bones each ...........i could have made a fortune lol
Eldest ............broke arm badly when she fell off one of our lorries unloading beer ( its ok the beer stayed intact )
then broke wrist when her pony nudged her over .funnily enough he did the same thing to another girl
eldest son ...broke one wrist at football training when he was in goal and his trainer kicked the ball too hard ...trainer at fault ? yes probably son wasnt very old , did we sue him ....not a chance
broke 2nd wrist when his freind fell on him , comsequently missed out on a school watersports trip .... but thats life
3rd son .......broke and disloctated finger when on a watershute , they sent someone down after him with out checking the shute was clear , they were negligent , but again one of those things
he then broke his arm ( badly) when at school and 2 others were fighting , landed on him and carried on fighting , i could argue they werent being supervised properly , but again with the best will in the world accidents do happen.
I know your daughter is very young and she has suffered some severe breaks , but now isnt the time to be worrying that she might suffer lasting damage , help her get over the accident , she must be pretty scared0 -
why would you sue? you get NHS medical treatment. you have no costs so why would lining your pockets make your daughters arm better?0

I am not sure what you expected by posting on here? I think that your original post did give the impression that you were undecided about whether to sue, and also that you were perhaps using your parents as an excuse to test the water of opinion. On a forum you will get opinion, those opinions on here back uup what you said was your own opinion, that is not to sue. So you are correct in your thinking, surely that has been helpful?

Just think it's really sad that anyone would even give the thought of sueing a friend a second thought. Accidents happen especially to children. I'm sure your friend feels bad enough.True MSE'r -Money Spending Expert
