Thanks everyone for your interesting and informative replies.
The tenant hasn't paid for so long now and I feel he has wrecked the house, due to the amount of callouts i've had to pay for over the past year.
I am incredibly angry and upset over the whole situation and out of pocket.
This is the kind of tenant that makes Landlords bitter and when the most angelic of tenants comes along, I now view them as potentially the worst.
On a more positive note, interest rates came down and so did my mortgage payment AND finally I have this date which i've waited for for so long.
The story about someone going to court on the day of the eviction, because of the baby, troubled me, I really hope this is the end of it.
I too, feel like giving the tenant a good going over, who wouldn't, the upset and expense caused I don't wanna even think about.
I don't believe in much, but one thing I do is Karma.

if you are to continue as a LL then you must educate yourself in how to get tenants out a lot faster .... join National landlords association if you have not already done so... and do a lot of reading.
dont let one bad tenant put you off future tenants- 99% are decent folks who just want to live somewhere quietly and pay the rent

Good luck Alex. When you do get a bailiff on the case, be sure to ask my former colleague for advice and listen to what they say - they will probably have a lot of experience of this sort of thing and can help you or your representative get this over with and moved on as soon as possible.If you don't stand for something, you'll fall for anything0

i would not want your job for anything - no tenant wants a bailiff - but 99% of prospective tenants want a decent landlord......
Thanks. I'm glad I don't do the job any more but as I said on another bailiff thread, I'm glad I did the job because you sure learn a lot about life from things like that. You see the best and worst of both the people you visit and the people who send you round to them.If you don't stand for something, you'll fall for anything0 -

How's your relationship with the LA who supposedly "managed" this let for you? What vetting procedures did they have in place from the start? How early on in the tenancy did they raise the alarm that things were going badly wrong?
Your situation should unfortunately act as a warning to any newbie LL who thinks that it will be easy money to buy at the low end of the market in certain parts of large cities and that they can then simply expect everything to run smoothly. You either have to be on the ball yourself ( hard when you're not in the UK) or employ an LA who is.
Tenants who don't pay for this length of time tend not to be the "can't pay" but the "won't pay" variety and your LA should have been pro-active.
Hope that you manage to regain possession without too much unpleasantness but if you are going to re-let the property I think you need to look for a new LA.
As it's Manchester, you may wish to avoid Rentapad ( search forum) and you may like to google LandlordAction, as well as signing up to a national LL association and/or Tessa Shepperson's LLLaw site..0 -
This tenant has cost the LL a years worth or mortgage payments ! Im my btl that would cost me 6k !!!!
Im sorry but i would use all resourses availible to me to evict the tenant, I would have no sympathy what so ever. Most LL I know have second / third properties as a Pension fund, not get rich quick . These tenants are jeperdising the LL future. Whatever the reasons for not paying, Its the tenants problem not the LL !!! Yet the LL picks up the bill !!0 -

unfortunately this just shows the ignorance of the OP landlord .. it should Never take 12 months to get a tenant out if you know what you are doing and have kept good records.0 -

I don't know - I've got one property where I think it is going to be around 12 months unpaid rent at eviction. I'm over 7 months in and don't have a court order for eviction yet. I believe I know what I am doing and I have good records.
Sometimes you just get dumped on from a great height and not even the best will in the world can get you out.0 -
The whole process can take several months even following the correct procedures and being an experienced LL. Case in question:
Tenant not paid for 2 months
Notices served, took month to get to court.
Hapless judge postponed for 2 months
Back to court, judge postponed for 6 weeks to give tenant chance to pay.
Possession granted, tenant has 2 weeks to leave.
So far, 7 months of unpaid rent. Luckily the T left voluntarily, other 2 weeks whilst going through 'abandonment of property' rules. Otherwise it could be up to 3 months whilst waiting for a visit from the bailiff to remove me.
So it took 7 months, but it could have taken up to 10! Thats following all the correct rules and procedures, so too criticise the OP for taking so long and going so long without rent is useless, you think LL's like having to wait so long? This particular person left with 6k of arrears that'll never be seen.
And this is not an unusual case!0
