Bailiffs coming

Options
Finally, hundreds of pounds and months of waiting, I finally have a bailiffs date to remove my tenants that haven't paid for nearly a year.

I have not been in this position before, can anyone advise, i've been advised to be there with a locksmith, the house is Agent managed, i'm actually working in a different country.

How did it work out for you, changing locks etc - no problem? (they're those modern white PVC doors)

I'd be interested to hear other peoples stories.

    why not pay the agent to be there on your behalf - the Bailiffs will need a representative of the property to be there - he cannot effect entry alone. The agent can take a locksmith with him.

    Many tenants leave before the public humiliation of bailiffs.

    Be polite, patient & considerate to/of the Tenant regardless of your feelings: Tenant has feelings & rights also, and a bumptious Landlord can escalate the situation easily.

    I'd at the very least advise the Police what is happening & invite attendance (then at least you can say they have been asked to attend...).

    Talk to Bailiff first & see what he says...

    Don't break the law, behave yourself & remember to look after tenants belongings left behind if you want to avoid later court action by Tenant.

    ""Tenant has feelings & rights also"" ????? tenants had a "right" and a duty to pay their rent - they brought eviction upon themselves.... sorry... no sympathy from me

    considerate to tenants who have shafted you - stole your rent - possibly damaged your property ? ????

    I don't think this is such bad advice - if you behave whiter than white and professionally towards the tenant you remove oppotunities for them to claim "harassment", chav goes to local paper about bully boy LL eviction, counter claims regarding ridiculous human rights....

    If bailiffs are involved there must be a court order in place for them to be evicted. The tenent has no special rights here, they would be in contempt of court if they refuse to vacate the property, and could be arrested by the police as a result.

    I agree. No matter how peeved you are with the tenants, the aim now is to evict, by the book, leaving no avenue for claims after the fact. You should seek to fulfil your obligations as a landlord no matter how onerous/unjust/unfair that may seem - remember not to confuse "justice" with the law.

    Dear Clutton: Re. the sauce I had 1/3rd bottle red wine, since you ask (bizarre question). And yourself??

    Strange though it may sound, and I agree I don't always follow my own advice, but being considerate & polite IMHO usually gives you the best result in most circumstances. And, btw, can really really wind some people up, but doing that would be reprehensible...

    Alex, my understanding of this situation when the bailiffs are involved, is that they will evict the tenants physically if required to do so - so long as they have a court warrant to evict.

    It is best for the tenants to vacate peacefully, but if things do get messy, the bailiffs will call the Police, and the Police will intervene and help throw the tenants out - court order is legally enforced.

    Seeing as the tenants haven't had no respect for you towards paying rent, they definately have no feelings and we shouldn't give sympathy to these sorts of people. A year without paying rent is shocking - personally, I think the law should be changed to have these tenants locked up - at least they'd have a roof over the heads - which we'd be paying from our hard earned salaries via tax!

    On a seperate note - how come it's taken one year to get the courts to evict? I've currently got a problem with my tenants who haven't paid for almost 4 months now, and they've made no attempt to resolve. I have a court hearing date on 31st July - hoping that they vacate before then though.

    on the rare occasions i have evicted tenants (2 in 10 years) - on one occasion i did not go - but sent an agent - i would have slapped the tenant involved had i gone - (long story) - and the second occasion i planned to go and gloat from across the street, but they had moved out the previous day - darn it !
