I have received my first cashback cheque plus court costs. If you are owed money by this company, follow this easy steps:
1. Contact your local Trading Standards office --(http://www.tradingstandards.gov.uk/) who will contact Birmingham Trading Standards on your behalf and set up a meeting with Just 3G Communications (as they are based in Birmingham). Explain to your local Trading Standards office the circumstances of your claim and they will advise you accordingly.
2. If correspondence with Trading Standards does not persuade Just 3G to pay you your cashback the next step is the "14-day period" letter. Essentially send out a letter to Just 3G Communications at the address listed on their website -- https://www.just3g.co.uk -- (not the incorrect address listed above), stating that if they do not pay you your cashback within 14 days, you will issue a county-court claim. Make sure you send this letter by recorded delivery so have PROOF that the letter was sent and received by Just 3G Communications (it can be tracked and traced via the Royal Mail website).
3. If the company does not respond to this letter within 14 days. You are now in a position to issue a county-court claim. Go to: https://www.moneyclaim.gov.uk/csmco2/index.jsp
Money Claim Online is a government service which allows individuals to claim any amount under £100,000 in the small claims court. And the best thing is--no paperwork--it's all done on-line! It's free to register and the cost of a court claim (£30) can be recouped from the person/company you are claiming from. So effectively the person/company who owes you money will just end up owing you even more money. Follow the instructions on the site and a county-court claim will be issued. The claim is deemed to be served five days after issue (to allow for postage), after which the company will have 14 days in which to respond. If they do not, then the court contacts them directly asking for the cash, after which a warrant can be issued to reclaim money owed (which you pay for but again is recouped when the person/individual finally pays up).
In my own personal case, Just 3G did not respond to my e-mails, my "14 day notice" letter and it was impossible to get through to them on the telephone. Unsurprisingly they proved extremely responsive after receiving a county-court claim. I was awarded the £67.50 which was owed in cashback in addition to the £30 in costs (which was recouped separately as they felt they didn't feel they owed me it--quite simply, they did).
I offer this advice to others who feel they have been conned. Do not simply put this down to experience or let it slide. Stand your ground and don't be conned out of YOUR money.0 -

yes excellent post gmanp007
I'll just add that you need to do these things quickly as such firms have a habit of disappearing - in fact my main concern is that they may have already effectively done this ie the origional firm is dead and the new phoenix will deny any responsibilityTANSTAAFL !0 -

Good post but most cases aren't as cut and dry as that; as a rule, the company concerned will issue a Full Defence to the claim even if they know that they owe you the money.
Once this happens, it gets transferred to your local court and cannot be dealt with online any more.
Then, because you are limited to the number of words you can use online in setting out your case, they will ask the District Judge presiding over the case to have it struck out for "inadequate Particulars of Claim".
It's a long, drawn out procedure (I've just won a case I started in May 2005 for money outstanding to me from December 2004) and even though the Small Claims Track of the County Courts are intended for non-legal people to pursue their claims, you need to have a rudimentary working knowledge of things like CPR Guidelines, Witness Statements, Statements Of Case and Part 18 Requests.
And you need to prepare yourself for the fact that the company you are suing will almost certainly ignore any Directive issued by the Court in the run-up to your case being heard.
I agree with your sentiments though, too many people roll over and allow themselves to be walked all over. You'll always miss 100% of the shots you don't take - Wayne Gretzky
Any advice that you receive from me is worth exactly what you paid for it. Not a penny more or a penny less.0
