I'd be tempted to claim to be homeless and set up camp on the vendors lawn after parking my car across their drive to block them in.

Such trespass (as there is no criminal intent) isn't a police matter I think.

But resisting their lawful attempt to expel you is a crime, They call the police, then in front of the police they tell you to leave, you don't leave, and the Police arrest you. Oh, and the dog will most likely get excited and attack somebody, and then the dog will get put down.

    Back to the drawing board.

My opinion is that it was at that point, when they asked to push completion dates back, that they knew they weren't going through with it and the big time lapse has simply been so they could scrabble around and get advice.

Had they already exchanged contracts when they asked for a delay in the completion date?

How about sending the big guys in, I know a couple of ex baliffs, they know how to get people out, and a lot cheaper than court ;)

Is that why they are ex-bailiffs?

That they hadn't exchanged on their new-build (btw is it actually built?) by the day of completion is plain stupidity - even if they themselves are ignorant about the process their solicitor should have made the situation clear to them. I wonder if they are blaming him/her and will try to use this in defence if it gets to court.

Love to be a fly on the wall in their solicitors office - WW do you get any sense as to what he/she thinks about their clients activities?

  • They may have lead their solicitors to believe that they were either going to move into rented accommodation, whilst they were waiting for their new build to be complete. The fact that they could not get the required mortgage on the new build must have panicked them!. Quite frankly I can't see the attraction for these shoe box sized new builds, they can get a lot more for their money on traditional build properties. They should complete, move into rented then shop around for a bargain, there are still plenty out there. They would be in a stronger position to pursue something else. They haven't been refused a mortgage, they have chosen not to take up the present mortgage offer. On this basis alone they'd lose the homeless argument.

just out of interest, why would anyone take anything the vendors are saying as true anyway? they are clearly doing everything they can to squirm out of a bad situation and i would take everything with a bucket of salt, let alone a pinch!

I would visit the new build sales office. Pretend to be interested and find out which is the house your sellers are interested in and when it is going to be completed. That may give you an idea of the sellers timescales.

To add: is there any chance of writing to them to ask what their exact financial situation is? If they hadn't exchanged on the new-build where were they planning to live after they'd completed with you??![/QUOTE]

I wouldnt have any direct contact with them otherwise they will then think its informal, the options you've given them arent serious & just threats & they're likely to lie about finacial sit anyway to get what they want.

Keep to the solicitors. It will convey the message, its formal, its serious & a very real situ that wont just go away!

I think you should go on holiday and leave the vendor guessing for a while. The rest of us can watch Eastenders or something.
