    May financial karma crap on them from a great height.

    I really feel for you, moving is such a nightmare and just when you think you can breathe a sigh of relief they pull a stunt like this. :wall:

    First of all do not agree anything with the seller without consulting your solicitor.

    If you really want the house, tell your solicitor to apply for a court order forcing the seller to complete. I'm not 100% sure but I think you'd even be able to recover any costs incurring in obtaining the court order from the seller as well.

    Alternatively if you are not too keen on the property, you can still negotiate a settlement and get not only your deposit back but also compensation for the costs you have incurred and inconvenience you have gone through.

    Hopefully things work out well for you.

    Many thanks for the advice and best wishes all. I'm feeling a little better as we've now had advice from a friend of parents who happens to be a solicitor specialising in the contract end of things. He's confirmed that we could force sale through a court and get costs, however he thought it could be quite protracted and did say that there could be issues if they still refused to move out.

    I just want to say to those of you completing tomorrow please don't worry, our solicitor has said this is as rare as hen's teeth, they've simply not had vendors pull out. It seems that these people are trying to buy in a London 'burb and aren't happy that the price they agreed to sell their rural cotswold house for doesn't fully cover the cost of the 4 bed detached new build they want....so they're trying to pull out and put the house back on the market in the hope they can achieve more. They won't; the surveyor unusually gave a valuation on this property and it's exactly what we were paying for it.

    There will no doubt be a lot of talks tomorrow and I'll keep this thread updated in the hope that it helps anyone else finding themselves in this unusual position in the future.

    Your help is much, much appreciated - it's been a long and emotional day!

    On a serious note I'm gutted for you but I think it would be great if you could keep us informed of what happens and what options you have to consider because somewhere, sometime, someone else will want that information.

    I think there is a good chance they will come to their senses when they realise what it will cost them. I expect their solicitor is on the case of letting them know the full consequences and that needs to sink in.

    If that's the case, I wonder if they'll relent when they realise they could end up paying the estate agent fee, having to return your deposit, and getting sued by you? If they're worried about finances now, this will not help their situation :eek:

    Anyway, see what your solicitor has to say about your options tomorrow morning...

    Off topic a little my daughter purchased a house a few years ago , everything packed and ready to go arrived at her new house and the sellers had not packed a thing washing on the line they were sat watching the telly ,daughter told them they had to move out to which they replied but we did not realise it was today ,lots of angry ranting later and contact with solicitors they then agreed to start packing ,to hurry things up my daughter and her husband had to help then out it was a nightmare and it took until the early hours of the morning just to get the van unloaded.
