criminal record- does this mean they cant work with children

    Mr Pinnington has never even been charged with an offence, never mind convicted.

    This man has lost his job and may never work again due to rumours, gossip, speculation, heresay. Read the judgement, click the link. Bloody hell, isnt just 1 case like that more than enough?

    As far as your friends case is concerned, post the judgement. Its public knowledge.

    As far as challenging goes, you can only do it if you know its wrong. You shouldnt have to be a lawyer to apply for a job otherwise you would be a lawyer, wouldnt you? Anyway, given your clear admission earlier that you had no idea about rehabilitation periods, yet claim to deal with them every day, makes your advice on this matter worthless.

    You tell me not to assume you know me, yet you keep implying that I read the Daily Mail :confused: You should also be a person IN the job too. I think a growing number of people are becoming aware of the kind of imcompetants that are social workers.

    As I said before. If someone is that desperate to get personal info, they simply need to be a postie. When I was on that job, I could find out anything about anyone on my rounds, all with no CRB.

    You state that 'Children have the ability to grow, learn and mature and benefit from Restorative Justice unlike many adults' and yet in your last paragraph you say 'I am proof as I have already said, because yes years can change people' Do you know what contradiction and hypocrite mean?

    Finally, Im probably pi$$ing in the wind here, but can you provide a link confirming you assertation that 1 in 4 applicants with convictions get the job?

    Hi all,

    Well i got my position nursing in the NHS 3 months ago, my CRB came back Friday with a driving ban of 1 year in 2006, when filling in the application form i did not declare it as i honestly thought that once ban was over in 2007 and fine was paid that it was all over, UNFORTUNATELY no i was sacked today from a job i loved dearly but it does not include driving for my position, i have spoken to HR who were surprised that they did not attend my meeting, which may i add i was called into while on the sick !!!!......Seems the justice system and NHS are in ruins, i have never harmed or hurt anyone and all i want to be able to do is help people but a driving ban almost 4 yrs ago has now stopped a career i loved with a passion.....

    I can't provide any links for that, and I've possibly already mentioned NACRO as giving helpful advice on how to disclose. But I'll mention them again, in case it inspires junkmayle to investigate the job market again.

    Welcome to the seventh circle of Hell Littlecat, where rehabilitation is but a fleeting shadow. According to Shel, its your fault as you should have been aware of all the intricasies of law, rather than waste your time filling your brain with nursing nonsense. Dont worry though, just sign on and Woody01 will get a second job to keep you in benefits seeing as you will NEVER nurse again. Dont you feel glad that you wasted all that time studying. You should have known that you were a risk careering your car through the ward, snatching up any stray personal information that may be lying around that you can sell on to your abusive partner. Im not trying to make fun of your situation Littlecat, merely the stupidity of a system supported by Shel and Woody01

    I'm guessing it's not the actual ban, but the fact that you hadn't disclosed it, so they weren't expecting it.

    May be worth contacting NACRO and ACAS to see if there is any mileage in an appeal: you don't have many rights when you've been somewhere less than a year, but if HR were surprised not to have been invited to the meeting, there may be grounds for appeal / reinstatement.

    I'm really sorry this has happened to you. NHS policies would allow you to appeal this, on the grounds of your misunderstanding of the law and the ban. It sounds like you have not been fired for the offence but for failing to declare it. With those making the decision assuming wrongly you were trying to hide it. Your confusion with the law shows you were not trying to hide it from them, I'd seek legal advice.

    ETA check out the flowchart on page 10. This is the procedure they should follow if you appeal the withdrawal of the job. http://www.crb.gov.uk/PDF/CIPD_Employing_ex-offenders%20guide.pdf it mentions the stage at which you could lodge a trbunial claim if they refuse to budge.

    Thank you for the advice, i genuinely did not realize it was still in place when a ban finished, and can`t believe how silly i was not to bring it up just in case,but in 41 years i have never been in trouble and not aware of the law and how long things stay with you, totally gutted

    How long ago did this happen? Not long I hope, you have 3 months from the date of dismissal or if you lodge a gievance from when it has been investigated and you get a reply. Read the information on here and go see a solicitor as soon as possible http://www.employmenttribunals.gov.uk/ You can lodge a cliam yourself, just download the forms but I would suggest getting a solicitor to do it.

    It happened this afternoon, the ban was it 2006
