Small Claims Court help - Refund requested - Judgement phase

    I'd contact the court and ask them not to process it for now, while you try and find out the trading address. I'll do some digging and PM you.

    There is no point whatsoever in sending in the bailiffs to St John Street. There is nothing there. It's a waste of £70.

    Leave it with me.

    ETA: I cannot find anything. I've looked at all the various names and addresses, but there is no trading address to be found for Albany Distribution Limited.

    Do you have any further info re the Bury address?

    I agree - the warrant (and the claim for that matter) needs to be executed on the registered office address for a limited company. If it's not a limited company, then it needs to be executed on the company owner's address.

    It used to be the case that a claim had to be issued at the RO address, but you can now issue at a trading address. You've always been able to issue the warrant to the trading address.

    It is simply pointless to issue the warrant at the RO - there is nothing there that belongs to the company.

    Unfortunately, I cannot find any trading address at all.

    So will I not get my money back now? The only thing I know about the Bury address is that their stock comes from there.... What would be the best thing to do now?

    All I can think of is applying to the court, to order the directors to provide information re the company's finances. Or to apply for a third party debt order (but you'd need to find out about any bank accounts they have first).

    Unfortunately, you will need to throw more money at this in an attempt to recover what you have already lost.

    How did you pay in the first place? I assume it wasn't by credit card (ie, you haven't tried to recoup the money from the CC company)?

    Appoint a bailiff on a percentage, let them add recovery costs and take it directly from the company.

    This will cost very little and be very effective.

    I paid via my Barclays Visa Debit card. Will I be able to get it back this way?
