Accident at work - their fault - what do I do now??

    You could make a fortune taking over from that woman with the unfortunate fringe who falls on her !!!! in the compensation ads.

    Thank you so much to those who aren't trying to make me out to be a liar etc, you are right I don't have justify it or ensure that my typing seems 'believeable'. Thanks for all your advice, the reason posted on here early is exactly the reason sausageface stated I need protect myself and my future as soon as possible and that is what I am trying to ensure that I am doing.

    Before you go, can we have the name and address of your doctor. (his surname could actually be Christ)

    The speed and accuracy of his diagnosis will make him a global icon and i want to get on his books before he is full.

    God I really hope the same happens to all of you and you get torn apart like you have to me.
    I thouhgt MSE was for people with hope and compassion not cynical a******* that clearly have nothing better to do than not try and tear vulnerable people down.

    I would not say you are vulnerable - you are well able to defend yourself, know your rights, and are happy to exercise them!

    I had an accident at work and stupidly didn't put it in the accident books as it didn't affect me until several days after. Heavy box fell on my shoulder, several days later the pain started.

    Not really worried about the compensation side of things but the long term effect. Back is mostly alright but does twinge at times - particularly in bed.

    I would ensure it is reported and recorded. Then best to wait a while as you need to find out the long term effects before you submit a claim. In you case, I would claim whether it is clear cut or not as back problems are very serious and you have to live with the after effects for a lifetime.
    Please do not quote spam as this enables it to 'live on' once the spam post is removed. ;)

    If you didnt report the accident & it isn't in the book you won't have a leg to stand on unfortunately.

    The same kinda thing happened to my sister, she was off work for a few months before Xmas due to injuring herself at work.

    Staples wouldnt even pay her sick pay & even threatened to sack her as they have an attendance management scheme & she had gone over the permitted sick day limit.

    The manager should put it in the book it's their responsibility.
    My sister had an accident (she fell too) and was taken to hospital.
    The deputy manager who was in charge that day was duty bound to put it in the accident book.
    They have to get health and safety in to check up and their report will be needed should you apply for industrial injuries disablement benefit or lodge a compensation claim.
    Just ring up and check it's been dealt with.

    I have to say, you don't sound vunerable.

    Aggressive, certainly. Out for a quick buck, perhaps. But not vunerable.

    Just as a matter of interest, I have a long standing back problem, I have managed to work through it, but recently had no choice but to have a lumbar disc replacement. This is major abdominal surgery with many risks & considerable pain. However, I expect to be back at work within 3-4 months. Never, in the whole time has any Dr told me ( & without the benefit of tests) that I would never be able to work again. Unless you have fractured your spine I am at a loss to understand how you could have been told this, or have you fractured your spine?
    Also, it sounds like your employers had warned your colleague to move the boxes, so it seems to be his/her fault, not your employers.
