Accident at work - their fault - what do I do now??

    So how did they get behind you ? You said someone had been asked to move them so they had been there for sometime.

    My friend said they had been delivered a few days before

    one I didn't register them because there isn't normally stuff in that spot and two when I walked I was in position where I couldn't see them and then during the conversation whilst talking to the colleague I moved around

    Maybe you should phone your work firstly to confirm that your accident has been logged in the accident book then to check what sick pay you are entitled to.

    Remind them that the boxes were in the walkway & that someone had been previously asked to move them.

    If you dont get anywhere threaten to go to your local newspaper as im sure a Health & Safety Company will not want any bad press.

    So the boxes had been there for days but you weren't paying due care and attention and didn't see them. Also there is a big difference between having a back problem and proving that an "accident" caused it. As you are trying to gain financially from this you really need to improve your story - you will have to deal with more difficult questions than the ones I've asked you.

    If anyone was at fault it was you for not paying due care and attention and your collegue for not moving the boxes.

    Thanks you so much for your help bunny999, now please make way for those posters who actually under the severity of the situation and who understand how much this will affect a person's future and not just their bank balance
  • As you work for a H&S company you will understand that they will have to report this incident under RIDDOR so you will get a letter from your local EHO.

    Also under the regs they will have to investigate the incident (which they should have done already) which would involve an interview with you and anyone else which may have seen or heard the accident at the time.

    You could ask to see the investigation report and 1st aid entry, but legally they do not need to show this to you.

  • Sorry forgot to say that you are able to put the accident into the book but it would have to be marked a belated entry and you maybe asked why you did not report the incident sooner (even if you want off to A&E always always make sure the 1st aider but the incident in, you company policy and procedure should cover this)
