02 contract

does anybody know where i may stand, i 02 have been debiting my bank account with payments which were for an old contract I took out with them nearly 3 yrs ago, which I cancelled when it was up after 18 months which i then took a new contract out for a different phone and number. I no longer have any contract with 02 but i noticed on my bank statements that they were still debiting the account, i have emailed them and it has now come to light that the payments were for the old phone, and they are saying that because i did not cancel the contract as a goodwill gesture they will now cancel it at once if i want them too, but they cannot give me a refund, i have emailed them back and told them to recancel and to credit my bank account with all the payments they have taken since this contract expired. i have phoned my old telephone number and it went to somebodys answerphone on orange. I no im stupid for not noticing this before but 3 of us had an o2 account being paid out of same bank account, do you think i have any chance of a refund, added up its a lot of money.

    Did they give you a PAC to keep the number and you just decided not to use it?

    hi, im trying to remember yes i think so, cos i was going to keep the number but then decided to keep the one what came with the phone

    your phone contract doesn't cease after 12 months. you just cease to be tied in, it just continues month to month with the same charge unless you change it.

    hi kavanne so because i changed that contract for another one with 02 would the new one automatically cancel the old one, even though i no i def cancelled it when i took on the new contract

    If thats the case then, the account never disconnected.

    When disconnecting you have 2 options...

    take a PAC and once you use it it disconnects, if you don't disconnect then it turns into a 30 day rolling contract.

    Set a 30 day disconnection date, it will disconnect on that date.

    It seems yours has turned into a rolling contract. I think if you are calm and polite, explain that you didn't realise nor have it explained to you that if you didn't use the PAC it wouldn't disconnect, then perhaps you could get some money back, maybe half or so as a goodwill gesture.

    thanks iwanttosave, i will give it a try although ive already emailed them back asking to debit my account with monies taken as I had cancelled the contract

    Nope is the answer, you have to specifically request cancellation of the contract and get a final statement of account. You can have as many contracts with various networks as you can pass credit checks for (13 with the same network is biggest i have heard) so just because you took a second contract with O2 means in no way would they cancel the first, also if you requested a PAC but didnt use it, your contract would have just gone on to a month by month rolling agreement that would have been explained to you at the time. Sorry to say but you are at fault with this one from what you are telling us, plus have you not checked your bank statements or account for the last 2 years?

    thaks for replies, one thing puzzling me is if im still in the contract with o2 then why has someone on an orange contract beein issued with 'my number'
