capital one

capital one sent me a bog standard letter saying i was getting zero because i agreed to it on the telephone.know it was bog standard because it said if i want i can cancel my ppi.my account with them finished in jan 2009.Sent them a letter on 4th of june stating that i would like them to reconsider due to the fact i have 2 pre-existing med conditions and would have told seller this if i was asked.Have had conditions for over 20years.They recieved letter on the 8th of june and since i have heard nothing from them.What course of action should i take next and how long should i give it?sorry if it was long winded.Your help is valued and appreciated x

    Hi Trish

    I would move this on to the financial ombudsman service now if I were you, you can either download the form on the FOS website or ring them,

    And let Cap one know what your doing as well if you want to by enclosing a photocopy of the completed complaints form, this way may make them change their minds, if they do and in your favour, then all you have to do is let the FOS know.

    You could if you want write and request for the copy of the recordings, if you have not requested a SAR you they should send the recordings through this, let me know if you require the template letter for this.;)

    I told them in my last letter that if they did not reconsider i was going to the fos with documention from my doctor to substantiate what i was claiming

    You have a great case here Trish I think and the FOS are surely to put this right for you, when you complete the form, also let them know you want to be considered for extra compensation from Cap One on top for the stress they have put you through in this matter which does not help your health condition as it is.;)

    When I read your post about this, it made me mad, and of course you would not have accepted the ppi due to your health condition, this goes to prove they did not discuss or make sure with you first, and if they can also provide the recordings, that would be good, the FOS would I imagine ask them for these anyway.;)

    Trish, keep plugging away at Capital One. They dig their heels in, but cave in the end - just don't take no for an answer. Refer your complaint to the Ombudsman if necessary.

    I kept at it and got almost £800 back in mis-sold PPI, and I know others on this forum have also had successful reclaims.

    Just make sure you do everything by post (recorded delivery) and you set the timetable. If they don't reply within the prescribed timescale, report it to the Ombudsman.

    Good luck! It sounds like you have a strong case :dance:

    thanks for everyones support.been mulling over it.do you think i should request a sar?even tho it was 9yr ago apparently that it was purchased if they say it was sold on a certain date by telephone would this be included in the sar if they were able to give me an exact date?

    Hi Trish

    An SAR is optional, if you've absolutely no paperwork, sometimes this can be helpful, even though you should only receive anything what they hold on you going back for the last 6 years depending where you live.
    So its entirely up to you Trish.;)

    With one of mine, I requested last year I was surprised to be sent documentation as from 2001.X
