Oh! Fair point Dora. He did say that he was told only spouses could be added - in which case, what would the policy be for same sex couples?

I know that adding his name is purely to ensure he would have a roof over his head but it seems a little unfair that joint tenancies are only available to husbands and wives. (Am I right in thinking a spouse is a "lawful" partner?)

    The issue is this

Even if your brother was on the tenancy agreement for the cornwall house, then he would not be able to move into retirment housing. Its specifically designed for older people to have thier own community of other older people, and to provide security. I work in an older peoples social work department & UNLESS your brother was effectively thier live in carer ( ie bathing toileting, using hoist equipment, all the "activities of daily living", cooking cleaning that sort of thing) the system Im pretty sure wouldnt allow it. Retirement accomodation, sheltered, etc, they wouldnt allow your brother because of his age.

If he wants to be close to your parents theres nothing to stop him moving into his own flat, the thing thats stopping him is his own lack of motivation, probably cos hes had it so easy for so long.
 Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
Theres no dollar sign on piece of mind
    This Ive come to know...
So if you agree have a drink with me, raise your glasses for a toast

Loopholes on gender and sexuality are not exploitative when the issue of age is concerned, and it will be blindingly obvious to the support workers in the accomodation that the bloke living there is his son.

Hi Lynz; the intention was for him to be joint tenant in Cornwall so that if and when parents moved, he would be able to stay in Cornwall house and ask to downsize. He has been told by parents that he can move north too if he wishes but would have to find his own accommodation. He currently wishes to stay in Cornwall.

Parents do not currently need full time care but if and when they do; I am prepared to take on the role. :)

if you manage to get your brother on the same tenancy as your parents, and then your parens move out, there is no guarantee that your brother will be abel to succeed the tenancy. For your brother to have any rights to a tncy ewith our dad he would ahve to be a joint applicant, and I can't see the LA would go for that.

your brother is better presenting as homeless. I know he prob won't be a prioirty, ( re: his problems is he under the dr?) but if he wants an area with a ,lowish demand he could still get rehoused. And if that doesn;t happen the LA will at least be able to prvodie info on getting accom in their area. Addresses of good landlords etc. So it would still be a good idea to present as homeless

Why doesnt he just approach the council as homeless then when the parents leave? Or they can give him notice to quit, and then he approaches the council and gets accomdation from there? When He gets downshifted it will be to a flat in any case.

Thanks to everyone for the helpful comments and pointers. I think the best route would be to market the business as and when my parents decide and then when we have a date for the sale to go through; this will be something "solid" for my brother to get his head round.

I can't even begin to imagine how daunting it must be or will be to be told you are going to be made homeless and I think the big worry is what if the council don't help him? He won't have anywhere to go and as much as i want him to stand up on his own, I find that thought hard to bear. I know many people beofre him and after him will be in similar predicaments but it's so much harder when it's close to home, so to speak.
