I don't see what is "wishful thinking" in stating that a card issuer has a duty to statement its customers. Sending a monthly statement of account, either on paper or electronically, is a contractual and statutory obligation placed on the card issuer. If they fail to do this, then they have no legal right to apply charges on the account for late payment

The cardholders obligation is to make the minimum payment as notified. Put simply, no payment is due until the the bank notifies the customer as such. I don't see why you have such difficulty in understanding this rather simple concept.

I'm intrigued by your assertion "It is both parties responsibility to ensure that the account is running OK". Could you point me to any terms in a credit agreement that explicitly state this?

The OP certainly appears to be somewhat naive, but this doesn't change the principle that I have outlined. You however, seem to be unable to see past your own presumption that the OP is simply trying to avoid repaying their debt. I don't presume to know what the OPs ultimate intentions are, I have simply commented on the general principles as I see them and offered some basic advice. Whether or not my view "washes" with an "ex Markies Financial Services employee" is not my concern.

Get off your high horse, and realize that not everyone would think that if a statement was not received, having spent on the card, then their obligations to not pay would be sufficient.

As mentioned before, and I will mention again. When you take out a Credit Card, it is assumed that once the card is received, normal people would contact the card company and ask them when the statement date is, this in turn allows for any changes if their chosen date is not convenient.

I for one would not spend on a card, and then sit back and think when my statement was being produced, I would want to know from the onset, further more, this then relates to the fact that I said it is both parties responsibility to ensure the account is running OK, you don't need terms in a Credit Agreement to state this, it is common sense and anyone who would think differently is as naieve as you are.

We don't know for sure what details the card company in question uses for the OP, but if you have not had a statement for a while, surely it would ring alarm bells in your head to tell you that a payment would certainly be due, would it not? If the OP hasn't phoned the Card Company and questioned why statements are not being sent, yet then can get his details on file stating that a card is open in their name, and there is a balance on it, then I find it rather odd, but it need not have gotten to this stage of being charged late fees, so I still stand by what I stated earlier, why should they reverse the fees, why would they reverse them and I still also state that it is wishful thinking, as if they did this to all their customers who claimed to have never received statements, no one would have a card, they would end up going broke.

If the OP had paperless statements selected, they would've had to have done so via their online banking...
Considering it's the customers responsibility to make sure the contact details are correct with the bank then I'm not sure where the issue is here - having said that, it seems that the OP may have a separate customer profile set up whereby all the current accounts are on one profile and the credit card is on another profile.

Phew, its difficult to know quite where to start in response to that. In future, could you try punctuating your text as you write it rather than applying commas and full stops as if fired from a shotgun as an afterthought?

Aside from re-hashing your original argument in an even more incoherent way, I don't really see what this adds to the debate. Anyway, the question over whether it is reasonable to apply as late payment charge in these circumstances is moot as they are likely to be illegal anyway - as natawstaffmember points out above.
The whole problem with the world is that fools and fanatics are always so certain of themselves, but wiser people so full of doubts.

    Hi

I have a credit card with Lloyds and for some reason it never comes up on my internet banking and when I ring the phone banking people it doesnt come up on their screens. It only comes up as existing on the credit card peoples computers, now ive been charged for not making my minimum payments. Can I refuse to pay on the basis that my internet banking didnt show me and ive previously rung in about this problem?

    Thanks for any advice
