How do I find out if Santander/GE Money were covered by the GISC?
In the final response letter from them - they said if I was still unhappy to contact FLA - unsure what to do now!

If you've any paperwork, it should confirm if they were covered by GISC on them.;)
The FLA are a leasing association that will look into these matters, I was given these details with one of mine through the FOS, and when I contacted the FLA they told me they could not help as the business I complained about were not listed or covered by them, unfortunately it seems to be the case for many here, but I have read that some have been okay, just give them a call, at least you have tried this direction, see what they have to say, good luck.;)

David - have found myself in a similar situation but I actually took out my Dorothy Perkins storecard in 1988. PPI was allegedly optional but it was a case of it comes with the card and if you don't want it then cancel within 60 days (accordingly to the very tiny small print on the agreement). Needless to say the salesperson didn't ask any questions about medical history etc and I have no recollection of her explaining it was optional or what it covered. I wrote on 29th June requesting reclaim and received standard "we are investigating, it could take 4 weeks". Today I received a letter basically saying it was so long ago and we have no records of the sales process therefore "I can find no evidence of mis-selling".....ummmm if she doesn't know what was done or said how can she be sure??????? Nor can she find a copy of my credit agreement (interesting, cos I've got one and am going to look at it from the enforceable point of view too). She also suggested if I wasn't happy to go to FLA....... worth a go will post back if I get any joy.0

Hi, just to let you know, I had a very similar response from another financial provider who said go to FLA. I telephoned the FOS and explained this and the FOS stated that they now do look at these complaints as well.
So that said, it may be worth giving them a call tomorrow, explain the situation and see what they say.

I actually received a letter from FSA today - I thought I would send in a complaint form to them anyway - they said they had a look at my complaint and because Santander weren't covered by them prior to January 2005 they cannot help BUT they did say and I quote -
'It is possible however, that you may be entitle to pursue a complaint against the underwriter (insurer), which provided your policy cover (although this will depend on a number of factors). i have been unable to identify underwriter at this stage; but if you could also send me any further documentation you have and in particular your policy booklet. I may be able to do so and set up your complaint against this firm'.
I have no idea who the underwriter is and don't think I have a policy booklet although I will have another look. The accounts were with BHS and River Island - does it mean them?? I am unsure where to go from here.If life gives you lemons, make lemonade.;)0 -
I am about to embark on PPI reclaim for a Burtons card. What tyroubles me though is the problems people seem to be having claiming from Santander, who now 'own' these cards. Yet when the cards were taken out the provider was GE Capital Bank who have already been fined for PPI mis-selling, a point which should make it easier to claim. GE Capital are still trading so is it worth taking a claim to them (in the almost certain knowledge they will redirect you to Santander) or do I go straight to Santander?
Also during the course of a (successful) card charges claim from Creation Finance I inadvertently included a PPI charge in the claim. Creation advised that this could not be included in the late payment charges claim (thats ok) but also said that any issues regarding the card insurance should be sent direct to the insurer (they gave me the name and address which I dont have to hand at the moment). Surely any PPI claim shoul be directed at the card provider not the insurance provider?
I'm confused on both issues! Any help would be much appreciated.0 -

I say in cases like this, due to the one taking over the other, write to 2, basically write the same letter, and make them aware that you have also wrote to the other, I think you got my drift, and this way your covered, and as you know you will receive probably a letter from one of them telling you to deal with the other, but this way your doing this in one.

The old address for GE Money is identical. So one letter to this address should suffice.
I have recieved a similar response from the FOS recently - they suggest the underwriters of the PPI policy. I have written to GE/Santander to enquire as to who this is.
However, I personally think this is a bit of a red herring. I see it as GE's responsibility to get this right, as they are the company that sold me the product.
Next step for me is to look and see what response I get re: underwriters, then probably go back to FLA with a more robust position statement detailing the requirements set out in the codes of the FSA, ICOB, GISC and ABI. If the FLA won't take that on board and uphold a complaint I will give it one last burst with the FOS, then off to court.
I would urge everyone in this situation with GE/Santander to keep going. If you are sure of your facts, keep in there. Keep going along every possible route that you can. If only a few people persist, they will continue to ignore us and try to fob us off. I have been fighting GE for 18 months already and don't plan to stop!
Continue your complaints, write to your MP, lodge formal complaints with the FSA (won't help you claim but will let the FSA know there is a continuing problem with GE). About time GE/Santander got a bit of bad press to see if that shames them into action.
Perhaps the MSE team could also publicly challenge GE on the grounds of a systemic failure to uphold the requirements of FSA Principle 9 - Relationships of trust??0
