Estate Agent Using My House Sale as Advertising

Hi. Can anyone advise me please? I have recently sold my property - not yet vacated house. I came home from work the other day and a neighbour handed me a card that had been put through her door. Basically it showed a picture of my property and was a blurb about how the estate agent had sold a property in the area and they were using my sale to try and drum up more business in the area. Can they actually do this without consulting me? Grateful for any advice, thanks.

When we were STTC, our EA did that usng our house. I didn't mind. It's probably in the small print, not that I've looked.
I don't see the problem, personally.I love giving home made gifts, which one of my children would you like?:A

You need to check the agents agreement to be sure. In our case we had this covered that we were permitted to use in such ways as well as Press Releases and features on Web sites/s and brochures.
However I think we may of been the exception and I think many agents will not have this in theri agreement.A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.0 -
Which bit are you objecting to?
That they used a picture of your property.
That they used your sale as the basis for the pitch.

- They own the copyright to the photo of your house. - Complete strangers could take photos of most houses from the street and own the copyright to the image, which could then be sold to many companies to use in many situations.
- They sold the house, so haven't lied.
- It's probably in their T&Cs too.
No case to answer... forget it and concentrate on packing.0 -
its a bit cheeky, but basically its not going to be your house soon and having a big ol sold board in the garden is not a lot different...0

You were OK with them using the picture to sell the house for you, but not for them to find other houses for the people who didn't buy yours?0

Our estate agents did the same. It didn't bother us at all. In fact, it made us laugh because they put one of the leaflets through our own door, the delivery person obviously not seeing the large sold sign at the side of the house.0

Having paid the EA £1700 for their services I do object slightly to them now using my sale for free advertising! But more annoying is the fact that the have printed picture with our car plus registration number clearly visible. I thought that at the very least the registration should have been "fuzzed" out. This is not the picture that they used in our original schedule.0
