Robert Dyas Refused Refund Without Receipt

I bought a cheap chopping board from robert dyas at the beginnnig of the week, which after using and then washing it up in the sink (not a dishwasher) it has warped! The water wasn't that hot as i managed to avoid burnnig myself!

When i took it back, (in the robert dyas carrier bag i got when i bought it) they offered a replacement (no point as its obviously a problem with the design) or i could get goods to the value (no point as i want a chopping board, not anything else).

They said no refund without a receipt. I didnt keep the receipt as it was only 6.99 and i didnt expect a simple plastic chopping board to be able to go wrong!

I had a bit of an arguement in the shop but the manager would not budge. I called customer services who also wnot budge but the IT team are going to search for my reciept and then post it to me at some point in the future.

Why cant they just give me my money back? the item is obviously the same as they stock, its obvisouly faulty, its obviously hardly used as it has only a couple of nkife marks in it too. I'm really angry with them.

Angry with them? Why? Why do you find it so hard to understand that you need a receipt at proof of purchase? The shop isnt in the wrong here, YOU are.

    No need to shout.

Angry because i bought an item in good faith which has turned out to be poor quality and not fit for the job.

When confronted with this rather than put their hands up and do the decent thing, they didnt. I had to call head office, and now have to faff about to get my money back on an item that should not be sold if it cant do the job.

    I think its dishonest.

I've done nothing wrong other than buy the item in the first place.

Anyway, are they legally able to do this, consumer rights sites seem to be grey on the area.

Without proof of purchase, they don't legally have to do ANYTHING.

If it is faulty, then they will refund you in full with a receipt or bank statement etc. as proof of purchase.

THEY are not to blame for you not getting your money back. YOU are for not keeping you receipt. I would do EXACTLY the same thing in their situation...

Losing your receipt doesn't mean losing your statutory rights. Having a receipt is of course helpful but the receipt doesn't make the "contract" legally binding. However, you do need to prove you bought the item from there and when. Without this, they do not have to give you a refund.

I would take the replacement and be happy with that. :)

I'd trust my customers and keep goodwill. Customer loyalty is worth something, especially if you get caught selling poor quality items! I'll go to Argos over the road next time.

...and get a receipt for the replacement. Then if it goes wrong again, you can get your refund.

I agree, they could have given you a refund, what's £6.99 to them if it means keeping a customer? But legally they didn't have to and that's what it all boils down to. Get the replacement and flog it on ebay :D

Requiring proof of purchase is a way of stopping shoplifters stealing items and returning them for a refund claiming they bought it.

i like the idea of a replacement and getting a receipt for that! They actually offer a money back guarentee with a receipt if you're not happy, so maybe i should just do that.

I'll probably wait for them to post me a receipt and then get my money back.

I understand the shoplifting point if there was nothing wrong with it and i wanted a refund, but its broke in a way i couldnt have planned on breaking it to steal and then get my money back by breaking it.

    Thanks for the advice! :-)

I'm glad the emphasis (via capitalisation of words) helped you understand you point. It's not meant to be offensive, it's just a simple way of pointing out the important parts of the response.

2 points for you though, as a newbie:

    1) If you're gonna get shirty with someone, you could at least spell their name right...

    2) We are a friendly bunch here (well, mainly) and just because you don't like the advice you are being given, it doesn't give you the right to post with an attitude...
