I thought that if the partner could prove they contrinuted to the house, helping pay mortgage, paying for decoration, they could seek compensation from the courts.
Not the same as a claim on the house, i know.
Again bluey, a bit of a myth, having said that if I invited someone to live with me, I would make sure the mortgage came out of my bank account, and I'd keep the statements just in case....... a woman scorned and all that.;)0 -
'Upgrading' nearly always means taking on more debt, how is that a good thing ?
Yes, usually something more expensive would require more debt.
I'm really not sure what the problem is with that.
If I buy a better car it would cost more than my current car and my monthly repayment would be more.
As I go through life and earn more and more of a salary, I can afford higher repayments on things.

Not so with houses though in a bubble, I would suggest the average salary (or many people's salaries at all) have not trebled in the last 12 years, and so they would almost certainly have taken on more debt compared to salary increase over that time.0 -

I believe that law as now changed. I think after X years any partner can claim like a divorce.
(it was changed due to gay relationships etc, but i am not 100% sure on the entitlements.)
I believe you can't chuck out a parent with parental responsibility for a child.
I.e. if the house owner wanted to leave, they would have to leave their house.
But that does not mean the partner has the rights to any of the house. And they have to make arrangements to move on, I believe.
Though it's very patchy! Common Law stuff comes in, and then it get's tricky.0 -
My definitiion of "the average buyer, buying the average house" would be somebody on their 2nd or 3rd ladder-progressive property buying a 2-4 bed house that they could stay in for years to come.
So, think married with 2.2 kids, Ford in the driveway and 3-bed semi.0 -

There isn't and never was a 'common law' anything, it was a total myth, I have it on good authority from a divorce lawyer. If you own the house you could live with a woman for 40 years, have 5 kids with her, and throw her out onto the street with the kids if you so wished, and there would be no recourse to yourself, other than being a bit of a !!!!!!. Plus the £6k tax free allowance.
So you start paying 40% tax over £43,400 (or so)0
