    and topic

    154318-final-demand-court-action.html on the CAG site

Lots of interest and input/feedback from the experts of at least one of the forums, but from 'sources' they have been very quiet about it and will only accept they have helped in they (the defendant) win and if they lose then they will deny ever helping.

Thanks for the clarification. I dunno about the latter bit though.

I had hoped, from someone so very much in the know, the real case numbers or a link to them and not old cases on CAG and Pepipoo. So far there's not a lot to go on.

Maybe because there's nothing to say?

Trying to find details of the Telford case, only because its the first, and cannot get anywhere. Any bright ideas to finding the cases that infotouch is referring to?

Lots of people have challenged (perky or others) to take them to court but he has not yet risen to the challenge.

I've checked out that topic, it seems that the defendant, who seems fairly clueless, sent an "appeal" to Combined Perky Solutions admitting to being the driver, and was asking for help back in Aug 08. There are a few more posts going up to Nov 08, when the court claim was issued, and nothing since.

So it seems likely that CPS might win the case if the defendant isn't armed with the proper legal facts, and they get a dozy District Judge. Or it might even be a set up, like the Stephen Thomas case, where the defendant appears to have colluded with the PPC to lose the case, just so they could crow all over the internet about how their tickets are legal and enforcable.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

So are you now trying to say that Thomas colluded with the parking company, I have heard some wild accusations but this time bargepole you have beaten them all, I do not think there is any sane person out there who when looking at the facts would agree with you (facts, you remember those).

It does seem that any case that a parking company wins is only because the defendant does not have the legal facts or the judge is dozy, that is quite a sweeping statement and of course on the back of that proves that your argument wins.

If a defendant admits to being the driver, why would that matter if the legal arguments you keep spouting on about are so sound and valid ?

As for my original question about the Chester case, I have been informed that no one from any site has helped with the defence which I find quite strange as some of the wording contained in the paperwork I have seen is very much in line with defences submitted previously by the experts, but I am sure it is a co-incidence.

So if the defendant wins the case no credit can be given to any site, if he loses then I am sure it will be down to a bad defence or dozy judge - Or maybe, just maybe the parking companies concerned are getting it together and presenting cases in a way that win.
