    their defence is likely to be filed at the last minute. you don't have to do anything at that stage because you will have to wait to get the documents in the post anyway. theres no rush in the british legal system and you wont have to make any reply until you get the court questionnaire :money:

  • Peeps - when you get your questionnaire, remember to send a cheque back with it made payable to "HMCS"

  • If a claim was Acknowledged on the 6th Aug 2009, its 28days isnt it.

    That makes it the 3rd September as the date is up,which is next thursday (1 week thurs), im away with work at the weekend for a few days. What can happen if this expires and i receive no defense, or i receive a defense and dont put anything back..

    It's 28 days from the service date, which is five days from the date you filed, giving 33 days in total. The date they acknowledged doesn't matter.

    I need a tank, I saw an ad : an ad for B&Q
    They had a great big water tank, so I knew what to do
    It was a really reduced price at only £50 quid
    With pump and filter. ‘Great’ I thought, so this is what I did:
    I clicked on through, and paid the bill, on credit card, no prob
    An email came, the tank was mine! So now I had a job
    To dig a hole – a great big hole, so dig – then dig some more!
    I couldn’t wait to see it delivered to my door.
    But wait a sec, now what is this? A second email came
    My water tank – that’s not to be. Now this is such a shame!
    ‘No stock,’ they wrote, oh, what a mess. ‘Computer glitch’ they said
    So, what to do? I asked myself. A contract can’t be dead
    Because they made a mess of things, I just don’t think that’s fair.
    They said we had a contract – in black and white it’s there.
    I phoned them up: ‘We cannot help, we have no more to say.’
    I wrote to them, and they implied, Now please- just go away.
    They said ‘We have discretion to sell or not to sell.’
    Which is much the same as saying customers can go to hell.
    ‘The price was wrong’ – Oh no, not that – it was there up on the screen
    ‘Reduced to this from this’ it said, so what else could it mean?
    So here we are, much later now, it’s soon to go to court
    With lawyer’s fees and travel costs, it all adds up! In short
    I love your shop, your staff, your stuff: so please – just send my butt.
    You got it wrong, the fault is yours, the case can then be shut.

    BP may state:
    "This term is intended to address the rare instances where the defendant is unable to supply the goods for any reason"

    Underlined and highlighted for a reason is the word "rare".

    Not only do they not know the meaning of "Discretion", but it can be said they don't know the meaning of "rare" either.
    Sackman would not disclose precise details of the systems that had caused problems. Its IBM Consumer Demand Management Service with DemandTec had not been set up to check stock levels of heavily discounted products sufficiently frequently.

    So almost 4 years on and a known issue not sorted - again I repeat "negligent".

    Here's a more recent item showing B&Q's popularity in e-commerce. Surprising that they still have not sorted out the problems - they seems to have given high priority to getting people to click through by choosing the right words and colours to attract buyers, but not the same attention to sales fulfilment.
