Hi
I ordered a water butt, but when I initially complained about non delivery I just got the brush off.
Just wondered how the court case went and whether it is worth me initiating a claim?
Any guidance welcome.0 -
dead and buried now.0

As a footnote to this thread and as a caveat to anyone considering such a course in the future, here's a cautionary tale:
The one case that got to caught lost. The claimant was ordered to pay the Defence's legal fees which ran into the thousands. Not content with the amount the Judge ordered the claimant to pay, B&Q are now pursuing them for further costs.
The only real winners are the Solicitors.0 -

Do you know on what grounds it lost? I thought everyone had such firm cases..“All you need is love. But a little chocolate now and then doesn't hurt.” Charles M Schulz0 -
Thanks P, and yes it never is "cut and dried", especially in the situation you are talking about - albeit different.
I'm not fully sure if I would put the time and effort in again - "been there and got the tee-shirt" is probably enough, but have experienced valuable knowledge which has been very handy when dealing with "naughty" mobile merchants.

I believe only one case has been lost and that was for multiple tanks not just one or two, which probably took it above the small claims limit, so perhaps the rules are different there and the case was not 100% water-tight (sorry!) .
I got full recompense and bought a tank - but not from B&Q (obviously as they don't have them or sell them any more!) but, unlike Tom's comment, it isn't dead and 'buried' as we bought an overground one and only buried it a bit, for stability. It's 700 litres and we are delighted with it!
So for me it was worth it - perhaps someone somewhere does know which court the lost case was in as it should be a matter of public record ......... Perhaps someone, somewhere has also logged the info all those who won......0
