    you need to enclose copies of what you wish to rely on. as far as i recall B&Q just cut and pasted MSE as the defence. If ellen morgan turns up again as trading law manager, watch she doesnt start mixing up consumer and criminal law again. Talking of which, i had the pleasure of meeting one of her ex work colleages the other day during our radio show. Interesting chat.

    don;t forget copy to court, copy to B&Q's legal representation. Make sure it is received on the last possible moment. If you dont get yours fax your court to tell them the defendant hasnt sent anything to you within the ordered time.

    re. b and q's "we didn't actually take any money so there was no contract" excuse, anyone who went through a cashback site like Quidco when ordering their butt(s) would have most likely had the sale track,validate and pay out a few pounds per butt. This would indicate that you had paid.The diy.com T and C's explain that the order confirmation email is sent upon payment and the legally binding contract comes into force. they are clutching at straws again and most likely will cave in shortly before the court hearing :money:
