Thank you for that Herbie21, I really appreciate it. I have filed my N244, and I have written to the solicitors asking them to send me details of the debt. The school said that the debt owed originally was higher than I had been told at the time of my divorce and that at that time my husband had agreed to pay the extra. I dont have these figures in my documents at all, not even in the divorce documents. I am going to do more looking at things and will will be considering my options but I really dont want to go bankrupt even though people say it isn't too bad. I just called the High Court Enforcement people and told them I was applying for a stay of execution, they were very cross and said I should not have done this and that I should only speak to them to sort things out and make arrangements only with them. She was very rude I have to say. I ended the call as she was upsetting. Should I write to them as well?Listing 1000 things on ebay 48/1000 (952 to go)0

An update - I have the court notes now. The debt was 5 thousand as I thought, in 4 years they added seven thousand pounds in interest and the rest is made up of court fees and two thousand in bailiff fees. Thank you herbie21, I am having a copy sent to me by the solicitors, they say both me and my ex husband signed the original registration. The letter from the solicitors to the court states that the interest was charged at 18% per year, but that is on their letter and I haven't got the registration to read it there yet. In the beginning when we owed the school fees we paid monthly and never, ever paid interest and no one ever said about it.Listing 1000 things on ebay 48/1000 (952 to go)0

Sorry have been away for a while - in relation to the High Court Enforcement Officer you will find that the named person on the letter is in fact an agent for the Authorised High Court Enforcement Officer - which is quite normal and legal.
The advice concerning making an application to set aside the judgment is sound advice, but also at the same time that you apply for this make sure that you also request a 'Stay of Execution of the Writ' The reason for this is that even when an application for setting aside has been made the enforcement agent CAN and often DOES continue with enforcemetn i.e. seizing of goods.
To safeguard the custody of your goods I would suggest that you leav no external goods around such as vehicles etc.
If, what you say, is correct in relation to the fees I believe they are extortionate and you should challenge them with the Company. Additionally, you should perhaps consider a complaint about the Enforcment Officer - to the County Court if they are certificated bailiffs - but many who work on High Court work are not - so the only redress is against the company - or possibly the High Court Enforcement Association.0 -
thank you maninthesouth. I have applied for a stay of execution but have not heard anything yet. I did tell the High Court people but they were not too pleased and said I should only have dealt with them, but that was not the advice I had received.
I don't own a car, in fact I don't really own anything so I am not sure what they could take from me, I am afraid they could take things that belong to other people in the house though.
I am waiting to hear from the court and then will see what everyone has to say. I think the fees are high too. Of course they'd tell you only to deal with them, they don't want the court to look favourably on you and reduce their cut! They can't take things that don't beling to you, I *think* though I'm not 100% sure, that there's something the other people in the house can sign to say that it's their stuff.Unless I say otherwise 'you' means the general you not you specifically.0

I am asking for help again as I am really scared. I went out and got back home and there was a letter from the High COurt people saying that as I hadn't contacted them at all they would now come in even if I wasn't home and take my things. I have contacted them, I told them on the phone that I was applying for a stay of execution and they got cross, and I have told them that the things in the house aren't mine. What can I do? They can't come in and take your stuff if they haven't been in before. I'm not sure what you should do now, I'm sure someone will be along soon who is.Unless I say otherwise 'you' means the general you not you specifically.0
