    do you have any assets ? if there is nothing to take going bankrupt may be the best option. I would call payplan and get some good free advice.
  • I have no assets. I own practically nothing but my clothes. But bankruptcy is a very scary thing to consider, and I work for a boss who considers debt in a very very bad light, we deal with a lot of payroll in our office and I am not at all sure I would keep my job. And after years to get a job following my breakdown I can't face losing my job. I am keeping up to date with all my other debts, I have no defaults. Its just this one that is so different.

          1. I have spoken to a debt advice person and she said I should consider either an IVA or bankruptcy. I earn £1100 a month, my bills amount to £863 a month and my debts I pay total £172 a month. This was before this new debt arrived. I have maintained payments now on my old debts for over a year, and I have two accounts that I have never ever defaulted with as the amount I pay is quite small. I don’t know what to do now. Would an IVA help me? If I go bankrupt would my landlord have to know as I live in a shared house and wouldn’t want there to be problems.

            Can you confirm you have spoken to a debt charity (CAP,CCCS, CAB or NDL) rather than a fee-charging debt advisor?

          3. I spoke to national debt line. I was also helped to fill out the N244 form to apply for a stay of execution

            If I went bankrupt could they take things like books and dvd's?

          5. I wish! Thing is I truly have no assets, I own only basic things, I already lost (to my ex) or had to sell anything I had. Will a court believe I have nothing to sell?

            Yes. I think most people going br have nothing to sell, unless it's a car or a house. If you're seriously thinking about going down that route, why not try posting on the bankruptcy board, they'll be able to answer any questions.

          7. Thank you I will. I dont know how else to tackle this, and I can't bear what I went through before, so I am intending to be much stronger this time. Maybe it's time to let go
