Setanta Losing Premier League - What To Do With Contract?

Good evening! I've just seen on the bbc website that Setanta have lost their rights for the 46 EPL games this coming season and, as this was the reason that I took out a year-long contract with them, where do I stand with cancelling the contract?

I've recently taken out the 12 month / £8.50 per month contract and they said they would provide 46 EPL fixtures which the now won't - is that breach of contract sufficient for me to cancel?

    Their contract (for satellite) on their website says:-

    3. Channels and Programming
    (a) We can replace or withdraw advertised programmes. We can change, increase or reduce the number of hours of any of the Channels. We may encrypt or unencrypt any Channel at any time. We may transfer programming between Channels.
    (b) We can vary or withdraw any Channel and vary or withdraw the Option you have chosen.
    (c) If such changes are significant you may have a right to cancel under Condition 8(f) below.

    (8f) Notwithstanding any term to the contrary set out herein you shall have the right to terminate this Contract on one (1) month’s prior written notice to us during the Minimum Term for the following reasons only: (a) if within any Minimum Term the Subscription Payment shall increase for any reason described in Conditions 2(c) and/or 4; or (b) if during the Minimum Term, the number of Channels and amount of Programming shall change for any reason described in Conditions 3(a) and/or 3(b) and these changes amount to a significant reduction in the Service provided.

    I would argue that losing the EPL is a significant change. Give them a call and let us know how you get on.

    Anyway, they will go into administration and they will go bust. They owe too much and their business model/remaining rights( which wasn't working with EPL) will mean no-one will buy them (a bit like Woolies)

    I'll give them a bell today when their lines are open and I'll keep you posted - I'd also seen clause 8(f) and I wondered if that would be my get out clause - guess I'll just have to see how they interpret 'significant change'!!

    I've just came off the phone to Setanta, took 15 minutes to get through as they're understandably busy! Spoke to a very helpful gentleman who said the loss of the EPL for next season was speculation at this time but they will know for definately on Monday (maybe they're trying to rebid??). Told me that i could cancel by e-mail and gave me all the details.

    When I asked about the £8.50 per mont 12 month contract I took he says that it starts on 25 Jun so if I e-mail in before then and state I don't want the contract because of losing EPL I won't have to pay any fee as I've already paid the one month in advance. He also said that if they did take a fee that I would get it refunded as I cancelled before 25 June.

    Does thsi sound ok to everyone else? I think it sounds alright.

    I have a 3 month £3.33 contract (taken out for the last England home game) so I will give them a call and see whether they will let me cancel.

    Just called, got through straightaway, and they will let me cancel though I have to pay another £3.33 which I suppose is fair enough.

    So are Setanta showing any football then? SPL, England games etc...

    Still probably not worth keeping like.

    The e-mail address I was told is: [EMAIL="requests@setanta.com"]requests@setanta.com[/EMAIL]

    In the e-mail you have to put your name, address (incl postcode) and setanta account number. You've also got to say that you're submitting your notice of cancellation and the reason why you're cancelling with them.

    I believe that all of this has been covered in another thread on this forum but this is just what I was told this morning. I'm going to hang on until monday to see if they get the rights back to the Premier League. Who knows, maybe they'll get them at a cheaper price than last season?

    Nothing to lose by doing that.

    But MHO is Setanta are finished with the EPL.
