hotel asking for more money to keep my reservation?!

    I have an email confirmation and a screen print of the confirmation from when I made the booking

    From what you say it appears a contract has been formed. If the contract has been formed at a reasonable price (not pennies, but a price the room could feasibly be let out for) then what everyone else is saying about "mistake" may be incorrect.

    Traders cannot simply change contracts at will and just say "oh, that was a mistake" - fair enough if it was 2p a night, that's a clear mistake and anyone would recognise that as such. If you want to check what I'm saying the case to google is "kodak unilateral mistake" and see a trader who made £2 million loss when they priced incorrectly - check out the Argos case as well as a good example of the other side with an unrealistic price.

    Here is a copy and paste of their reservation page, the only t&cs they appear to have are that your credit card guarantees your booking which to me (In the abscence of other t&cs) would form a contract

    hmm thats a rather lousy set of TnCs

    it appears you do have a case as their own terms rather than allowing them to cancel have actually bound them into it

    please do shed light on your email though and if it shows any more terms

    This does indeed look like they have accepted your offer to stay 1 night at what I would consider to be a plausible price.

  • I agree that the new price is still pretty pretty decent for that hotel, however I much prefer my original agreement. I have stayed there before an understand that the majority of its trade comes from business use... so I did think I just got lucky with my weekend stay as the weekends are a lot quieter... and any time I have stayed there on business before (Monday to Friday) they would give out offers for weekend stays. Basically I thought it was a genuinely great offer.... well, if we can fly for a quid nowadays!

    Anyway, keep your thoughts coming!

    And below is the email I received regarding the "error"

    Dear Mr xxxxx

    We are writing to inform you that unfortunately your Hotel reservation at The xxxxxTrafalgar Square has not been confirmed. We have received an automated error message for your reservation due to there being a rate error.

    The correct rate for your reservation is £68.00+vat per night. Please kindly let us know if you wish to proceed with your booking.

    As a good will gesture for any inconvenience caused we are happy to give you a free upgrade to a Superior room.

    Wow, you did get a good price!

    Many hotels have been giving massive discounts recently, so you could quite easily assume that the rate was correct.

    I would definitely not let this drop - you have done all that is necessary.

    Speak to Consumer Direct for their advise as to your rights, but certainly on the face of it you have a binding contract at an agreed price so you should be able to enforce it.
