Things might have changed now, but some years ago my friend did exactly what OP did - he passed his test, put the form behind the clock on the mantlepiece and forgot about it. Some months later he was pulled over and told to produce his licence. The only licence he had was a provisional, as he had forgotten to send off for his full licence (HOW could anyone forget do do that???) But anyway, he produced his provisional licence and also the form that confirmed that he had passed his test. BUT because he had not sent off for his full licence he was done for driving while unaccompanied on a provisional licence and he was banned from driving for 6 months.
As I say things may have changed, but OP you need to get legal advice, you could have your licence revoked AND a ban for driving while unaccompanied.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

They are happy with the insurance has I changed it to cover my car whilst in the car with them. SO in theory I have been pulled for no insurance, they are happy with this but I need to take my licence in.

I'm not sure that's right, as sarahg1969 said you have 2 years to upgrade to a full licence. The pass certificate is an entitlement to drive.
In theory you can legally drive home from the test centre having passed your test (with valid insurance
)
Whilst it is a bit naughty to not upgrade, I can't see any prosecution for driving without a licence IF all the info posted by the OP is correct.
I would take the pass cert & licence in & see what they say.Always try to be at least half the person your dog thinks you are!0 -
I think there are TWO points here....
1 once you have passed your test you must forward the pass certificate to DVLA within two years otherwise you have to re-take the test
2 once DVLA has received the pass certificate, then, you can drive while you are waiting for your full licence to arrive from DVLA

I think thats just how it's worded.
Taken from the RAC website.
"But if you don't claim your test pass within two years of the date of your test, the entitlement conveyed by the test pass will be lost and you will have to pass a further Driving Test (theory and practical), for that category of vehicle if you wish to have it included on your Driving Licence.
Even if you've passed, your instructor will still drive you home from the Driving Test Centre - your concentration will not be at its best so it's best to sit back and enjoy the ride."
Note it's not for legal reasons that the instructor drives home but for safety.Always try to be at least half the person your dog thinks you are!0 -
LOL.... there does seem to be a lot ofr confusion about this area. This is from the DVLA website....
Which just goes to show that seeking advice from an internet forum is only as good as the information available!
OP - if you are still reading, it would be really useful to know how you got on, and what the outcome was?
Once the DVLA has received your valid application, the law allows you to drive before the licence arrives as long as:- you have held a GB or Northern Ireland licence issued since 1 January 1976 or another exchangeable licence
- you are not disqualified from driving (there are different rules for medium or large vehicles, minibus or bus drivers - the traffic commissioner for your area will decide whether to grant your entitlement to drive these vehicles)
- you have not been, and would not be, refused a licence for medical reasons
- you keep to any special conditions which apply to the licence

I've seen the DVLA quote you posted but nowhere can I find anything that states you cannot drive with just a pass cert, & I mean nowhere!!!
I've even dug out my daughters car pass cert (10 days old) & even on that there is nothing to say you cannot legally drive! In fact, it doesn't even have this bit once DVLA has received the pass certificate, then, you can drive while you are waiting for your full licence to arrive from DVLA which I have seen on many websites.Always try to be at least half the person your dog thinks you are!0 -

I won't get the chance to go to the police until the weekend as I'm working, so I'll let you know what happens. I'll let them hit me with whatever the give me as its completely my fault and I should have checked both things :rolleyes:0 -

If only the you had sent his PL off the day after then he might had argued that he had sent off his licence therefore 2 days ROT for delivery he is entitled to drive.
So he is entitled to drive.I all have learnt is from others on many sites.
Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.

Legal advice form a motoring specialist is recommended. A general solicitor will be worse than useless. Although no insurance is an 'absolute offence' there is a possible defense by virtue of the Statute.0
