    but what is going to happen in 7 days when I can only produce my provisonal licence? Shall I phone them today and tell them this?
    no they did not ask me to produce anything

  • sorry Silk, I'm confusing things. They never asked me to produce anything when they pulled me over.

    I have to produce them within 7 days, but obv this will only be my provisional x

    If you only passed your test last year and you get 6 points, you don't get a ban I'm afraid. Your licence is revoked.


    You might be better off seeking some legal advice.

    Does "them" include proof of insurance ?
    When you changed insurance to "a better one" did they not make a charge for this an increase on premium or a charge for the change of vehicle ???
    If it happened to me I would be livid and produce evidence of phone calls, certificates payments etc !!!
    I would not just accept a fixed penalty when it wasn't my fault :confused:

  • Tbh if your insurer gave you a certificate you will get out of that one.

    You will be prosecuted for driving without a licence though and have your licence revoked. possibly a ban on when you can resit on top.

    You really do need to seek legal advice, your main goal here is to minimise any ban/fine.
  • well I'm going down the printout later which clearly states the date it was changed on it, but the notice theu gave me only asked for me to produce my licencex

    They are happy with the insurance has I changed it to cover my car whilst in the car with them. SO in theory I have been pulled for no insurance, they are happy with this but I need to take my licence in.

    Eek - revoked? how long for?

    Although I can't believe that you didn't follow up both bits of paperwork, take the provisional licence and the pass cert with you and you might just get away with it.

    2) Re the driving licence. If you have never sent off your provisional you are driving without a licence as you dont have one until you apply for it after passing your certificate.

    Tbh its very likely you will be facing 6 points and a resit and a possible ban too if you get found guilty of both.

    It says you just have to apply for your full licence within 2 years, or your right to drive is lost. And further down, it says you may drive until you receive your licence except in certain circumstances.

    As for the ban and resit, you are wrong. 6 points on a new licence means revocation. You don't get a ban as well.
  • What it means is you have 2 years after passing the test to apply for your licence otherwise you will need to resit the test. You can drive whilst waiting for the licence to arrive after applying. I doubt however if you simply forget to put in for a licence and keep using the old one this counts as you dont have a full licence.

    I think it does come down to interpretation and thats why the OP needs professional legal advice

    Re the revocation. correct and most likely in this circumstances, but bans can also be levied. for example if the OP killed someone in the first 2 years they would get points, a ban and revoked - and the extended version. Although in this case it is most likely revocation.

    You also may have insurance issues as the OP may have had invalid insurance given they will have told the insurer they have a full licence and don't.

    The OP is certainly on dangerous ground here and could well be facing a ban. it may be they dont get it revoked as they dont have a licence to revoke and instead banned for driving without a licence - i.e what they often do to underage joyriders.

    All this aside OP get legal advice and quick before you speak to the police again as you do not want to incriminate yourself even more.
