    We've spoken to a neighbour who is a police officer who will check a few bits of law for us on monday but as the DVLA were notified about a month after the incident of the change of address they MIGHT be outside of the allowed time for pursuing the matter anyway. He'll check up for us on monday to see what the law says :)

    1 if you and OH are in prison you will loose the house anyway.

    2) Its stupid to take the hit when is previopuse points have expired as regard less of then the event took place come the court date he will have 0 points at the start and possible more at the end.

    3) There are many drivers on the road with over 20 points (mostly taxi drivers and couriers) as long as you get a letter from his employer advising he needs to drive to secure his job the court will be lenient.
    If it doesnt pay rent sell it.

    If you already have 9 points on licence for what ever reason, it is stupid to then speed, however rarely & especially if your the one bringing main income into household. In this prediciment I'd probably take the wrap too, but I'd give him a bloody hard time & suspect while this may be the first time caught it is doubtful this was a one off at 13 miles ph over speed limit.

    Hello, I'd like to resurrect this thread as I have a friend with a similar problem..

    As I understand the DVLA website, an endorsement (ie penalty points) stays on your licence for 4 or 11 years depending on the offence.

    The "totting up" rule means the driver will be disqualified if he/she has incurred 12 or more points in any three-year period.

    Therefore it is possible to have more than 12 points on your licence and not be disqualified, providing the earlier points were more than 3 years ago.

    I have also heard that anyone with 8 or more points is not eligible for a fixed penalty notice and must instead go to court. Does anyone know what the definition of "8 or more points" is - does it mean points within the previous 3 years, or any points remaining from any date on the licence?

  • I feel very sorry for you. My husband was caught in a 30mph zone doing 36mph. £60 fine plus extra on insurance. However i would never break the law and say i was driving. There is no excuse he committed a crime regardless of how unfair and you have to take the consequences. I find it frustrating hearing of all the celebraties who hire the best lawyers to get them `off`. At the end of the day you committ an offence you deal with the consequences. While i have every sympathy for you at what point do you justify lying?
  • I think you should take notice of what the police officer neighbour says and check it out with a solicitor.

    There are plenty of cases out there where people haven't lost their licence because their job and family depend on it and from the sound of things you have a very good case and a boss to back it up.

    It is easy for those of us that have never been put in your shoes to say don't take the rap yourself but, that is my advice when there seems to be enough of a case to protect you OH anyway.

    i am sorry but taking the rap as you say is lying at what point do you justify lying, murder, assault, there is no justification. In a court of law would you lie under oath? If we do not have law than all there is is anarchy, do you advocate this? A lie is a lie is a lie.......................
  • I've had speeding (will come off licence in Jan!) and my dad wanted to take the wrap - but no way! Speeding cameras are more and more accurate especially as you are a woman and he a man. Getting caught would not be fun. Don't take the points, it's illegal and dangerous.
