Sorry but it seems to me that if we all start taking points instead of the person actually commiting the offense why should they bother driving at the correct speed at all.

I know a couple of people that have taken the points (instead of their hubands!) and they cant see anything wrong with it as if it just doesnt matter that it is illegal.

I agree with David HM TOTALLY. Perverting the course of justice could give you a visit to the Crown Court with the risk of imprisonment. Sorry to be so blunt but you need to know before you go down this unconsidered path. Your husband should be honest with his dealing with the Magistrates Court. He can ask them to consider “special reasons” or exceptional hardship for NOT disqualification. It is not automatic that he will be disqualified; disqualification is discretionary in these circumstances. Speak with a criminal lawyer to get proper advice. This is not a case of “stand by your

It's worse than that it's allowing someone who is driving dangerously to stay on the road.Speed limits save lives.

    5. With regard to the original "no insurance" offence, are you sure your husband wasn't covered by the driving other cars extension to his own insurance? If he had a company car this wouldn't apply but the Court might have discretion to reopen the original offence and that, apart from anything else, could mean a refund to your insurance premiums for the last 4 years to go towards debt reduction.

He was a company car driver and wasn't covered by the company car insurance to drive other vehicles other than company vehicles...

Sorry to add a flippant note to a very serious situation and hugs to you at this terrible time, but my OH and I had to laugh out loud when we read this comment.

My OH is already on 6 points and it's just a matter of time before he gets more and my license is clean. You know "there but for the grace of God....." and all that. But we also own a "damned V6 coupe" and it just made us laugh as that is his temptation as well (mine too come to that, I'm just more careful!).

I have to ask - what V6 coupe is it....ours is a Peugeot 406 coupe V6 3 litre and we're just dying to know what your evil spirit is

Hyundai :) I've never liked it - now I like it even less... but we are in agreement. IT'S GOING! :T

As for all the other very hmmmm negative commetns then apparently there is a picture and there is no way of telling who is driving. He is going over to his ex to pick it up tomorrow so I'll know for sure then. If it is possible to tell who is driving from that then there will be no choice... he'll need to go to court. If t's not possible to tell then I see no way of the court system telling who was driving short of them finding this thread and tracking me down :)
Yeah it's not right to "pervert the course of justice" and no it is not an action I'd take lightly :( And yes speed kills. I have plenty of pictures of friends who are no longer with us to remind me of that. It won't be an easy choice but in all fairness then he has nver been done for speeding before and he doesn't speed as a rule. his previous 9 points were thanks to a friend who told him the car was insured for him to drive and it turned out not to be. He could have not cared and let his mate who was drunk carry on and drive instead of taking the keys of him and driving him home but he did what I would call the responcible thing. Even the officer who stopped them that night gave evidence commending him for doing the responcible thing but the magistrate obviously had a bee in his bonnet about something and gave him 9 points. OH learnt the hard way to not trust people to tell you the truth and to help them out

Oh btw... he ain't hubby yet :) just OH, but hubby to be :)

Firstly to put your mind at rest, a work collegue pleaded extreme financial hardship if he were banned and took points and large fine. He currently has 12 points on his licence, which should have done him for totting up. He was told that as a "rule" they only allow this defence once in any 4 years, so it is possible to avoid the ban.

Now a couple questions, the nip must be served to your DVLA registered address within 14 days of the alledged offence.

Is the car yours or company?

Did it arrive in time, can the new owner of your old house recall?

How long after moving did you notify change of address?

How safe would the roads be if everyone had 12 points or could 'get out' of being banned.

And lets face ALL drivers that have high points or get banned never think its their fault.
