    If you take the blame and get caught out, you both end up in even more trouble. If the first 9 points have expired the new points won't be enough for him to loose his licence.

    The points expired AFTER he got clocked at 83mph... so they would still be taken into consideration.

    I know what you are all saying, but would you really want to take the risk if it were your family income on the line. I know it is wrong to admit liability, however having said that I would never run the risk of my other half losing his job. I would cop the blame. Like she says, she drives really carefully, what are the chances of her getting caught again. However if hubby drives to as many places as he does, the chances are high that we WILL get caught again (I think they call it probability!!).

    Sorry to show a dishonest side, but self preservation would kick in here!!

    Oh he won't get caught again :mad: He's been informed that he is selling that damned V6 coupe and getting something cheaper to insure, slow and probably diesel! If he gets caught again I'm not taking the blame (then again at that point he'll have a clean license anyway). Let me put it into perspective... if he looses his license and then his job we loose the house... I guess I should decide properly once I see the paper work but according to OH's ex then there is a picture enclosed and it isn't possible to tell who is driving which is a relief as I know I was in the passenger seat and they'll never proove which of us was driving if the picture can't show it.

    the OP would get caught out........all her hubby says is that it wasn't him driving it was her, she agrees, pays fine and takes the hit on her licence. In fact I think the going rate for points these days is £100 per point ...my ex-boss was offering £100 if anyone would take the blame for his speeding - which we all thought was abit tight given the increase insurance premiums speeding points would attract.

    Tine - when I was referring to losing your income, you seemed to suggest in your OP that it was a case of either your hubby losing his income or you losing yours - although I apologise if I read it wrong.

    Might have been me writing it a little muddled hun :) No I wouldn't loose my income but we could loose his and with it our house... I'm just so angry with him right now for doing such a damned silly thing! The fine he can pay and any subsequent increases to my insurance I'll kick him for too :) Even if they fine us £100 per point and give me 6 points it'll be a relief compared to him loosing his license... MEN!!! :) (no offence :))

    1. If you take the points, it's called perverting the course of justice and is imprisonable, for you and your husband, which would be much worse than the likely short disqualification.

    2. Clearly your husband can't be disqualified retroactively. I'm also not sure that the points can be added to the points at the time of the offence, only at the time of conviction. Therefore he could only be looking at going from 0 - 3 points and therefore there would be no totting up ban, nor any automatic ban due to the severity of the offence.

    3. Was the NIP served in time? It should be posted so that in the normal course of events it would reach the registered keeper within 14 days of the offence.

    4. You need legal as much as financial advice on this. Try http://www.pepipoo.co.uk and/or go and see a lawyer.

    5. With regard to the original "no insurance" offence, are you sure your husband wasn't covered by the driving other cars extension to his own insurance? If he had a company car this wouldn't apply but the Court might have discretion to reopen the original offence and that, apart from anything else, could mean a refund to your insurance premiums for the last 4 years to go towards debt reduction.

    Sorry to add a flippant note to a very serious situation and hugs to you at this terrible time, but my OH and I had to laugh out loud when we read this comment.

    My OH is already on 6 points and it's just a matter of time before he gets more and my license is clean. You know "there but for the grace of God....." and all that. But we also own a "damned V6 coupe" and it just made us laugh as that is his temptation as well (mine too come to that, I'm just more careful!).

    I have to ask - what V6 coupe is it....ours is a Peugeot 406 coupe V6 3 litre and we're just dying to know what your evil spirit is

    Was it your OH that was definitely driving? If so and you admit to it-would this not be contempt:confused: and if caught could cause you and OH criminal convictions/prison and both be banned?

    Sorry, I understand your predicament but what happens if they have pictures of OH driving and you admit to it.

    Maybe Ive read the initial post wrong, but the above is how I see it!
