... ok, the CSA have responded promptly. Within 3 days they rang the NRP. With a day or so of that he has forms to fill in and they have given him timescale in which to do so (to send wageslips) - short timescale really.
He told them on the phone he is paying the mortgage for the house I live in.. and I think he wants to take that into consideration and not pay me F**k all until I am gone.
But the thing is.. this is HIS house, in HIS name.. HIS mortgage and I don't want anything to do with it. SO he is liable..
.. my point is.. why should he not give me anything whilst pretending he is keeping a roof over my head.. when clearly he is trying not to lose his house and he has a liability to pay the mortgage as it is his debt.
This is CS2 by the way.
Will he get away with this?

Nope. For CSA purposes, he has an interest in the property, and will gain from it when he sells. It would only matter if the house was in your name, and it was agreed by you that he was paying the mortgage in lieu of child maintenance.0

As the house is his and in his name, they cannot take the payments int consideration for a variation as one of the grounds is that he cannot have a legal interest in the property, which he clearly does.0

just a quick one here, what is to stop him chucking you out, if this gets nasty i would be more worried about that than getting maintenence0 -
They wont allow a variation on this property as he has a reasonable purpose for keeping it. ie to home his children. me thinks just and equtiable kicks in here.0

I am his wife. He can't chuck me out and if it got nasty - he would come off worse with a solicitor.
I need his maintenance to help me with the deposit to move, so I am doing him a favour really.
The solicitor would tell me not to leave the house .. blah blah... and we've been married and together quite some time.

CS2 might be different. Question is do you want to remain in the house while he pays the mortgage over it?
If yes, then you can sign a tenancy agreement and you can get housing benefit. He can use that income to pay the mortgage and free up income to pay you your CS2. The CSA (old rules at least) will not consider providing a free roof to be child support and he will be charged twice.
If you dont want to sign a tenancy agreement and the CSA doesnt let him retain enough income to rent a house then he can ask his lender to close the mortgage and cash-in the equity.0
