Hi,
I'm new to this forum and just have a few questions. My parents are trying to claim back their PPI on a mortgage that was taken out in 1991. They were never made aware of the actual payments per month and where not asked for previous medical conditions.
Therefore i sent off a letter on their behalf to the yorkshire and they have said that in 94 and 96 that my mother made a claim and that also because the insurance quote was provided by swinton and not them that they were made clear of what was happening.
I know that they were not as they would not ask me to do this. They denied the letter and said that the reclaim has been denied etc.
Now i wonder what i can do to be honest should i get in touch with swinton or take it to the FOS?
Any help is brilliant.

I think this one is for "Dunstonh" as its in regards of mortgage PPI, so hopefully Dunstonh will be along at some point today, fingers crossed.

They also included a letter/leaflet for the FOS it seems like there telling me to take it to them? this to me sounds like i wouldnt have a case0

They do that as normal probably good practice. Do not be put off with this if you feel you were miss sold you should get a lot more than they have offered. They are playing games. As I said get some figures and post them up on here. Somebody will help you.

Hi there
Normally after the business has investigated they do give you the opportunity to take your complaint to the FOS in order for them to investigate.
So if this was the response you had, then I would go this direction, it seems that you are eligible to go this direction with the FOS if they have confirmed this on the letter.
So for info on the FOS, you can either download and print the complaints form, or ring them to arrange to send you one through the post, here:

This is exactly what was said on the correspondence to yorkshire:
Thank you for your recent correspondence where you requested to log a complaint on behalf of .......... claiming that they were mis-sold their Key payment Protection Policy (KPPP). Your comments have been forwarded to me for a final response in my capacity as one of the customer relation managers in our service quality department.
I have thoroughly investigated this matter and can therefore confirm the following:
........ applied for this mortgage via swinton estate agents in oct 1991. This immediately confirms that yorkshire building society didnt provide ...... with any advice.
If i can refer you to page 4 of the original application form, a copy of which is enclosed, you will see that the Financial advisor at swinton who was dealing with ....... case, asked the society to provide her cleints with a quote. By signing the application form ..... agreed for us to do this.
Also on the same page, the Financial advisor wrote in the home insurance box 'compulsory completion of morgagte'. This evidences that the advisor was well aware which insurance were optional and which were compulsory. Yorkshire building society cannot be held responsible if swinton didnt make this clear to ......
after providing .... with a quote they chose to proceed with te KPPP as they opted to complete a KPPP application form.
A couple of years later, in 94 ..... succesfully claimed against her KPPP. A further succesful claim was made in 96.
Some years later in 2000, we wrote to .... to confirm that due to the fact that .... had reached the age of 65 he was no longer entitles to have KPPP and therefore we were removing him from the policy. This then promted ... to contact us to make some amendments to her policy. We then wrote to .... to confirm that her amendments had been carried out.
All of the above evidences to me that .... took out KPPP on the advice of Swinton estate agents and in my opinion, given the fact that successful claims were made, they were right to do so. I believe .... were well aware that they could amend/cancel the policy at any time and it is on that basis that i cannot agree to uphold your complaing and therfore request for a refund of all premiums paid, is accordingly denied.
If after reading this letter you still feel ...... were mis-sold their KPPP i can only suggest that you refer your complaint to Swinton.
I am obliged to inform you of your right to refer this matter to the FOS.

they have attached the proof of claims but seems pretty hefty considering that my dad is a taxi driver and also that he wasnt aware he wasnt covered anymore and also they didnt know how much they were paying.0

So they are saying as the insurers were Swinton, its down to them then?
As I think if its insurance related to the FOS, they are able to investigate these complaints.
So if you have not done so yet then, maybe you could write to Swinton, and send them a copy of the letter you received as above, so they are aware that they have suggested you write to Swinton for them to deal with your complaint, as its in regards of the insurance.
However, you can ask the FOS to write to them on your behalf if you wanted to and as usual its the 8 weeks.
