If he took her to court to evict her, and she offered a payment plan the judge WILL allow her to stay, and refuse possession to the LL, he will have to wait until she defaults on the payment plan before he can take her back to court.
My partner has done just that, went back for the 2nd time after a 7 week delay, the tenant offered to pay £1k by the end of June, judge accepted this and let her stay (Bear in mind she actually owed over £3k at that point.)
Needless to say she didnt pay, PO has finally been granted and now she has 14 days to get out, then instruct bailiffs which can take up to another 2 months. So all in all, it will have taken 7 months to evict her!
  • Thanks Emma that helps loads :o

Short-term contracts are probably a good thing then.

Plus it is up to the LL whether he allows his tenants to keep animals in his property...a good enough excuse to give them notice...

Does this mean you end up losing 7 months worth of rent? That's gotta suck :(
  • Just a quick query, if they have a small child and the dogs are pooing everywhere in the flat is that not dangerous to the childs health? Don't know if that's something that child welfare would be interested in?

Wow, not all rosy letting out a flat as many people seem to think is it?

    Good luck retreiving your costs.
