accident claim

if my insurance company admitted my liability for an accident is it me that has to pay the personal injury claim or them? Also after the accident I left with them as they were very unhelpful does this mean i would have to pay it anyway?

    Assuming you had a RTA
    And assuming you mean the third parties PI claim.
    and assuming it WAS your fault.

    Your insurers will deal with it on best possible terms.

    However your question is quite vague

    I will explain more.

    Last year my girlfreind had a car accident, she was pulling out of a junction, checking th road was clear she pulled out, and over the top of the hill a car was waaay over the speed limit and as she pulled out it crashed into her.

    The problem was the police were never called and details were exchanged, but tthis left my girlfriend liable.

    Our car was written off and the other persons car had a small dent or two. we phoned the insurance company who were very unhelpful, refused to give a spare car or let her claim at the time.

    She was so annoyed the fact we had to go out and buy another car we cancelled the insurance with them and left it at that, knowing although not really her fault in the eyes of the insurers it was.

    Somewhere along the line the passenger of the speeding car put in a personal injury claim and the insurance company admitted her liabilty.

    It was until today that we get the letter from the claiments court saying we have to pay out for their loss of earnings and the court/solictor fees.

    We are not sure what to do as done have the sort of money they are asking for, and if the insurance company admitted liability do we phone them and ask them to handle this claim, or do we have to pay it ourselves.

    Its just we are unsure as we are no longer with them although at the time of the accident we were with them.

    I assume you would have had summons etc by now if you've received a decision from the court? If this was the case, have you passed all those documents to your insurance company?

    Doesn't matter if you aren't with them now, as long as they insured you at the time of the accident.

    no not yet, I can photocopy them and get them too them straight away, would i have to phone my old insurance company and explain what its in relation too? I have no real info from them apart from their standard numbers like claims, quotes etc..

    As mattymoo said they will make a decision based on whats cheapest for them. If they feel its worth fighting the case they will fight it if they do not think they have a realistic chance they will negoiate the best settlement for them.

    By the sounds of the accident they will chose the second option

    sorry to be a pain but its really worrying, we dont have the sort of money that this person is looking for, when you say settlement, does that mean because they accepted the liability on our behalf or said we are liable they are under some sort of insuance law to pay it because they were our insurers?

    i though if we caused the accident we had to pay the money and not the insurers?

    Yes your old Insurers will pay it.

    It is a legal requirement in the UK for a car to have Insurance cover in place to cover any damage to other people or other peoples property.The Accidental Damage, Fire and Theft etc is purely optional.

    Your policy will cover the damages / repairs etc for the other driver along with any legal costs etc etc.

    Just send the letters into your old Insurers, it is sensible to send them recorded delivery or by fax so you have proof that you sent them in case your Insurers do not receive them. You could also ring the solicitors who have written to you and ask them to send all future correspondence directly to your Insurers if you want to avoid receiving the letters

    thanks this puts my mind at rest a little, hopefully our insurance comapny will sor tit out then, this happened over a year ago so we dont even know what the old policy number is or anything :s
