Quick update, hearing has been scheduled for this Thursday, met with solicitor the other week to prepare "bundle" for our defence which included 31 different letters from various creditors/suppliers. To date he has never heard from the other side. No letter from them since the original claim back in April nor is her solicitor returning his phone calls. And thats after refusing to acknowledge our agreement to a greivance meeting and going right to the tribunal. So now I`m super stressed and facing an enormous legal bill no doubt.

Another update, spoke with solicitor yesterday who adv he had heard from other side and they are looking for a quick settlement! He agrees the state of the business was horrendous, turnover went from 18k a month to £950 over 6 months. I have the eye bags to prove it!
We are going to represent ourselves as we cannot meet his costs, as much as I would love him to be there but hubby is a good speaker so have every faith in him.
I am so nervous and so angry that she is doing this.
Also have a witness statement from another employee about her behaviour.
Solicitor doesn`t think she`ll turn up and this will sway in our favour.
    Will update when it`s finished
  • Good luck.

I have just read through this thread and cannot beleive it's gone to tribunal.
This cheating mare is doing nothing to help those employees who have genuinely been a victim of discrimination.
I was a key witness at a tribunal many years ago and it was an eye opener for me. The main thread of the employees' claim was quite strong but he added other complaints that were ridiculous and he lost the case. Our barrister said if the employee had kept it simple then he probably would have won. BTW, I was a witnes for the employer.
Anyway I wish you good luck and hope you win and you can then focus on getting your business back on track and perhaps be in a position to offer employment to someone who is less skanky.
I am off on my hols tomorrow so will have to wait for two weeks to see how it turns out.
    Good Luck

Sorry, i'm a bit thick here. Your first post stated turnover increased by a third after the employee left...does this reconcile with the figures posted above?

Can you afford not to win? Did the solicitor indicate what his costs would be?

Have you sat in on a hearing beforehand to get a feel for the procedure?

Our bank manager gave us a condensed statement showing turnover and charges since last October and a letter stating any award would place the business in a very difficult position. Which it would. I am paying bills and no more. This letter shows the turnover increasing after she left. Our solicitor was £1500 a day.I have never attended a hearing before as this was my first ever employee.
