No you would not have to go to court. You would go to the Financial Services Ombudsman, which is free.
If this is really what you want to spend your time doing then you are quite free to do so.
However, I have a pension case with them at the moment and they are so overloaded that there is no case worker even assigned to it at the moment. So expect to wait many months if you want to go down this route. Obviously you could be without your cash during that time.
Personally I think there are better things to spend time and effort on.0 -

Had to email Egg a second time, with the subject heading "Please answer my question", as the first reply simply reiterated the 0% interest during anniversary, vs. standard rate at all other times etc. Second email was very specific, will be charged fee from 1st May INCLUDING anniversary, so about to call them up to cancel 9and at the same time SBT my latest stooze via Egg money!)0

Let's get one thing clear, if any of you have it in writing (e-mail or otherwise) from Egg whereby they have expressly said that no BT fees will be charged, they cannot go back on that.
Actually I have just remembered something.
A company is not obliged to stick to something that was said as a mistake.
e.g. an incorrect price on the internet.
People who have applied for TVs for 1p have found this out.
Where it is a mistake they are not obliged to go ahead with the deal.
I would urge caution to anyone thinking of going ahead on the basis of an email which we know is an error by customer services.0 -

Someone has posted here that MBNA will move a negative balance to your current account with no handling fee (they will of course charge for any balance transfer that takes the card to a negative balance) but that sounds a bit iffy to me. Meanwhile, Egg 'Money' (Mastercard) is certainly fee-free at the moment - and likely to stay so - since it is offered as a cashback card-!!!*-savings account and fees to withdraw your own 'positive' balance (the equivalent of an Egg Card 'negative' balance) would undermine the savings element entirely. Get one of these if you haven't already.

If you think that there are better things to spend your time and effort on, how come you yourself are using the ombudsman? Also, again on the time and effort argument, surely if you are prepared to expend time and effort stoozing, it does not logically follow that you are not prepared to expend time on taking a case to the ombudsman. In short, with respect, your views as expressed in this thread are riddled with contradiction.0 -

I think you should get your law on mistake straight - look up the House of Lords case Bell v Lever Brothers and the subsequent court of appeal decision in Solle v Butcher and then I think you will find you are incorrect.0 -
