im hoping someone can advise me... my local CAB have been un helpful. my ex partner unbeknowns to me has several debts and has not been paying them. i had a visit from bailiffs who were going to take my and my childrens property even though my ex does not live here. the debts are in his name but they stated that because it is this address he has used then i am liable for his debts. to prevent them taking my property i had to borrow £300 from a family member to get rid of them. they did say they would be back for another debt unpaid of my ex also.
i need to know if i am liable for his debts in his sole name. also, is there anyway i can disassociate from him or prevent him from using my address ?? i am worried every time there is a knock at the door. i am a mature student at uni and only have limited income...

If the debts are in his sole name you are NOT liable for them.
If you own the house in joint names then they could go after his share of any equity in that. But if it's yours or you're renting - and none of his possessions of value are in the house - then they have NO comeback on you.0 -
we own our home in joint names...i pay the mortgage... i do not have a forwarding address for him.. the bailiffs stated quite clearly that i was responsible for this debt or removal of property as it was at this address. i said several times that he does not live here and nothing belongs to him.. they wanted to take my little boys ps2 and tv that he was actually playing on and my laptop which i had all my uni work on...they would not have left without money or property..0

If it's not his, they can't have it. Simple as that. I know they try all the tricks in the book, but legally they have no leg to stand on. PM Herbie21 who is an expert in all things bailiff, she'll be able to give you better advice.0

In future, if they turn up, call the police. They have no legal right to take ANYTHING that isn't your partners. No matter what they say, do NOT give them anything or any money, as this will just encourage them to come back for more...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Many times they're not actually interested in whether they are right or wrong, they're just interested in getting money out of you. Already you've given them money; if you honestly do not owe this money then they've basically robbed you!
Pieces of paper stating your rights are of no interest to them. Next time they turn up, call the police.0 -
Unfortunately, there isn't a lot you can do to either stop your ex using your address or to stop the bailiffs coming round. Unless you have your ex's new address, then I'm sure they would love that information...
Please don't give into these bullies, if they turn up again, keep them at the door and call 999, tell the police you are being threatened and your fear for your safety, make them aware that you are a lone female (with child if they are with you) most of all, as said above, don't give them ANYTHING...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Are you sure you were visited by Bailiffs (appointed by a court), or by a Debt Collection Agency??"You were only supposed to blow the bl**dy doors off!!"0
