Triton are in-house RBS.
I did put my charge reclaim into RBS, and heard nothing for months. When I phoned RBS to chase it up they said Triton were now dealing with it.
I phoned Triton and they said they had not had the I&E form we had filled in from RBS and when they did would deal with our claim.
In meantime I got the court papers from Incasso regarding same debt, phoned Triton to query and thats when they told me that the claim had been declined.
In all that time we have heard nothing from RBS themselves.
I too would have thought being in a DMP was a very strong case for hardship but..........

With regards to the charges, I would contact RBS again and drill it into them about your DMP and the fact that as they added the charges, it was their responsiblity to sort it. They cant just refuse to refund you, as it has been proved that bank charges are unjustified and grossly overcharged.
I think a more miltiant letter to their head office would be in order! Tactics like that seem to work for some people.

I would only deal with RBS as they applied the charges. Are Incasso in house too or have they sold the debt on?
If they have sold the debt on, then there is the possibility that RBS would have to refund you direct rather than take it off the balance. You could then maybe use the refund to offer a full and final. All creditors work differently though, so dont quote me on that.
As for where to send the letters, send them to your local branch where you held the account. If you get nowhere with that, start sending them to their head office in Edinburgh. Always give a set timescale for them to adhere to ( 7 - 10 days). If they fail to respond, then move onto the next step.
I know through reclaiming ppi with RBS that they often fail to respond to letters. I got fed up with waiting for a reply regarding my ppi so decided to go straight to the FOS. Still waiting for a verdict!:rolleyes:0 -
I'm really really worried now (had voucher for M&S so 'lucklily' bought some new pants today!!)
I have £2000 CC debt with Tesco (RBS), looks like my DMP will be about 20 years so chances are I may also get a CCJ and my mortgage fixed rate finishes in 2011. :eek::eek::eek:
Anyone have any idea what happens at the end of a fixed rate if you have a CCJ?:D

Yellowmonkey (thanks) directed me here (looking at a DIY version of DMP now as one of possible options) so just making my way through the posts.
What has terrified me first though is the fact that whatever DMP one manages to set up, it is enough for one of the creditors not to freeze interests and all goes to pieces as one will NEVER be able to pay the debts off....

muddlemess - great to see you back, I'm not as knoweledgable as a lot of folk on here but just want to say, I understand how you feel, I've just started my DMP, well 1st payment due in July but I've sent all the letters and have started to receive responces back, I can't begin to explain the releif you feel once you get those first few letters (in my case as most have been quite accepting and understanding!) I'd say go for it and the sooner you commit the better, and the sooner your debt re-paid. : )you wont get a CCJ and your name wont be published anywhere, unlike IVA.I'm not sure if you'll get sorted for July, it's quite possible. Hope you're feeling a little better.
Thanks cleomolly, it's good to get support from people who understand and is really appreciated!! I've thought about it and now 'planning' to get it all set up to start August then that will give me July to try and stick to the budget....mmmm :rolleyes::rolleyes::rolleyes:

I havent started my DMP yet so not sure I can help but thought I'd let you know some one is here.... untill one of our knowledgeable people come along!!
I am terrified with the same doubts but after reading through the posts I feel more informed and as one of our fellow DMPers has said 'knowledge is power' (or something like that) which seems to help with the battle!

You would simple revert back to your mortgage providers standard variable rate. Considering that interest rates are at an all time low, this is not a bad thing!:D

Ok, made my way through quite a few pages and have to admit some thigs I do not understand:
1) Phone calls from creditors - how do they get your numbers? Especially work number?
None of my creditors got any phone number for me, my house number I have changed (only called BT and told them I get nuisance calls - they changed my number for free)is ex directory , I have changed the mobile number and never gave it to them, my work number has never been given to anyone. How do they get the numbers to call?
2) Being on DMP and not being able to reduce the debt as creditors keep on adding interest - what is the point of going into DMP then? Isn't it better to just got BR in that case?
Terifies me trying to sort out paying off debts and nto being able to - will keep on reading the pages here (going backwards from 17 to 1).....0
