Hi cloudy-day, don't beg them for charges & interest to stop. As I said yesterday ask for a copy of your CCA along with the £1 fee. I seriously doubt you'll receive it in the time allowed (12 days plus another 2 days for postage) because of the post strikes & secondly because Egg continually break the regulations. No doubt you'll have to go to the Information Commissioners Office like I had to. It takes time but its worth it.
Aside from the CCA request enclose another letter telling them you are trying to sort out your finances & are using a cost free DMP company who numerous financial institutions recommend when you are in financial difficulty. Tell them you are trying to reach an agreement with them & would be happy for them to sell your debt on to a DCA (that would be a great outcome).
Another thing to look out for with the agreement (when you get it) is that they usually don't have the default charges listed in their terms & conditions, which leaves Egg in a vunerable position.
As for getting back the £16 charges, you'll need to get the last 6 years worth of statements. If you already have them then great, if you don't then you need to do an SAR (subject access request) letter & enclose a payment of £10. If you do have to go this route, then forget about requesting the CCA with a £1 payment, thats because with an SAR you can request all the details they hold on you which means they'll have to send the CCA anyway. Again they'll delay responding.

Thanks very much - really appreciate it. I've only been charged the £16 (*4 - 2 cards 2 charges) for the last 2 months - I've been up to the limit for years but only ever 'broken the terms' (ie went on a DMP) since August.
Will do what you say geoffmr1 and advise of the outcome.

I entered a DMP three weeks ago with a recommended company and have no problems here, however I keep on getting other companies phoning me up telling me they can do a better service for no charge and use a "dept elimination scheme/plan" to wipe out most or all of my depts. One such company is called First Step Advice who claim they can elimiate most of my dept, anyone else had dealings with them?
What concerns me is if they can't eliminate most of my debts then I would have been better staying with my DMP?
All very confusing not knowing if I've done the right thing or not and should I do this new scheme.

Hello all!
I was hoping our DMP welcome pack would arrive today before the worst of the strikes, but the postie came and went and all I got was a Pizza Hut menu! I called up CCCS who said our paperwork has been received and processed and our Welcome Pack has been requested, so we should receive it (postal strikes allowing) within the next few days! :T I'll be so glad to see it all confirmed in writing!!!! :beer:
Here's hoping the start date is the 1st of Nov, not Dec!Will it be too late to start on 1st Nov now?

I suspect what these company's are referring to is seeing whether your debts are unenforceable though the courts which can happen if the creditor in question does not have the correct Credit Card Agreement(CCA) from when the card or loan was taken out.
It does not mean that the debt is eliminated, rather that it's unenforceable, ie the creditor can't enforce payment without the say so of the court.
These companies are just basically touting for business and will most likely charge you a fortune to look into it.
You can do all this yourself for a fee of £1 and using template letters which are on this site.
You are doing the right thing sticking with your DMP( is it with one of the free companies also recommended on here)
Don't touch anyone who tells you they can eliminate your debt with a barge pole, they are just out to make money out of you.

I had a a knock on the door and looked out the window and saw a very posh looking chap all dressed in a suit with a big briefcase etc and my heart sank, Northern Rock sent us a letter saying they would send a representitive to our home if we didn't clear our arrears, I panicked for a minute and then thought....I can do this. I steeled myself, took a deep breath and opened the door.....to a guy who was wondering if we'd be interested in cavity wall insualtion. :rotfl:He must have thought I was crackers I just burst out laughing. Cloudy-day, I really feel for you with your situation with Egg, I am experiencing the same with Marbles who are whacking on over £200 in interest, over limit and late charges every month.
At first they stopped everything then maybe 6 months or so down the line started again. The debt had started to reduce but is now higher than when I first started:mad:

Sorry to hear you too are still struggling with ludicrous charges. It seems to be one of the most unsettling things on a DMP, that nothing is written in stone and creditors can 'review' and negate your hard found payments on a whim. Hope you can resolve something with them soon (and then can you let me know the secret!)0
