but how do you know what to look for with all these credit agreements? Apparently they Audit the agreement and find out if the debt is inforcable?0

They check whether the debt is statute barred, ask for the Consumer Credit Agrement and then see whether what is sent back meets the requirements of the cONSUMER cREDIT aCT. - cost £2.
95% of that you can do on here with a bit of help from CAG.
Just to point out that the OFT has a warning out about these companies.
You can also check your charges and reclaim those - cost £11
They be useful is checking the more details charges but there are probably folk on CAG who could sort them out anyway.
If you need extra help, I suspect a £50 visit to a solicitor would be cheaper. If you've have not made a mistake, you've made nothing0 -

These companies are just after making money out of your money problems by pretending they can do things you can't, to the extent the OFT warns about them.

Hi hung:hello:
Welcome to the forumthere is some clause in the consumer credit agreement were you can get car loans, secured mortgages & Credit Cards written off from the debt
a) the debtor dies
b) the debt is settled.
There are circumstances where if a CCA cannot be produced, then the debt may be unenforcable, again it depends on what type of debt it is.
If your family member is having debts problems, take a look at mysignature
Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
I have just read through all the info on this and was wondering if this is a step by step guide for the DIY approach to this:-
1. I write to the company (using a template letter) I have my loan/credit card with and ask them to supply me with a CCA
2. They have 14 days to reply to me
3. What they should send me back is a copy of my original signed CCA
Am I correct so far?
4. If they cannot supply me with my original signed CCA - does this then automatically mean my debt is unenforceable?
5. If they do send me a signed copy what do I look out for in the agreement that would make it unenforceable?
If I am correct so far... please could someone tell me what I would need to do next?

hiya all
i had a leaflet drop from one of these companies and i gave it to trading standards when i visited them the other week, i think it was a local firm, cant remember but ts were interested in this
in very small print on the bottom it said they wanted money upfront for them to check out the cca and if unenforceable would then get all sorts of stuff sorted,
like others and im going to now go and check out stapley;s threads,
ive requested my cca,
some are illegible even ts agreed
some im now sending to fos for them to investigate as ive had my final letter from the creditor insisiting its okay
others im writing back as stuff is missing ie the back of the agreement, they will try all sorts believe me
so pls do not touch these companies, like ras has said have a look at CAG too im getting lots of legal stuff there and im learning all the time
do not be afraid, its your right to pay the 1.00 i send postal orders and do not sign your letters i use a sribble of a font off word and await to see what you get back
out of 5 so far, only 1 is the exact copy of what i originally signed and i have the original on this
take care and hope the above helps newbies ciao for now MAZSealed Pot Challenge member 1525
