Sorry I should have included a breakdown of what these fees were for. They were
Brokers fee £495
Lump Sum Asu £1750
Solicitors fees £440
The guy at Capital returns told me that it was illegal for Black and White to add these on to my mortgage and I could claim them back.
I know that we added them on because we didn't pay anything up front.0 -

I they manage to jump through the hoops correctly they may get a card/loan agreement deemed 'unenforceable', but the balance will still be there and the creditor will do all they can to collect.
They may ultimately not be able to go to court but they still lent the money and will still want it back.
I have researched this also- and my genuine feeling is that this is not what it seems.
Firstly, although the exchange of letters looks simple, an expert will know what to do and at what stage.
However I have met alot of these guys who run the companies who claim to write debts off and most of them have an NVQ in till maintenance at Tesco (sorry Tesco no offence). If this were a valid legal argument then high st solicitors would offer it as a service- yes, lenders are on a sticky wicket if they cannot prove the agreement and what was signed but I've heard that the courts are saying that if someone has been paying the debt for years and then suddenly turns up asking for it to be deemed unenforceable it might just get thrown out! I am not saying it doesn't work- I am just saying there are a huge number of dodgy geezers out there charging high fees for something that is very spurious. I am not sure there are even any cases yet as precedent apart from that couple in the North who did it.now debt free and determined to maintain good spending habits and build savings0 -

Not seen or heard of them before...they seem to be a debt management company? I tried a few scenarios in there 'do i qualify' page, and everyone qualifies.Outstanding Debt as of Sept 13 - NONE!

Hi There,
I'm a long time reader of moneysavingexpert and found it a great help, but now I'm hoping you helpful lot can help me become debt free!!!
Between 2004 and 2006 I had taken out 3 credit cards and by the end of 2007 it had got myself in around £10k worth of debt spread across all 3 credit cards, I had defaulted on payments on these for about 6 months at which point they were all passed onto debt collectors. After burying my head in the sand for a while I contacted a company called Debt Matters who put me on a debt management plan where I pay £180 a month towards clearing my debt which is paid to each of my creditors, and they have agreed to my payment plans and agreed to freeze all interest.
I've been on the debt management plan now for over 18months but I recently got a call from a company called Beneficial Claims, who say that they can wipe off all of my debt if I had taken out credit cards before April 2007 (which they all had been) due to irregularities in most credit card companies T&C's. Now obviously this sounds very appealing as it potentially means I can become debt free, now after the hard sell they gave me they also said that i would have to pay around £1k in fees for this to happen.
Has anyone else been in touch with beneficial claims? Has anyone been in a similar situation? Am legible to clear my debt even though the debt is no longer with the credit card companies and now with other debt collecting companies?
All advice is really appreciated.0 -
ppp - why pay £1k when a CCA request costs only £1?

After my post I read up on this a bit more and obviously the feedback is not to use these sort of companies.
I hope that I'm eligable even though I am on a debt management plan, although i feel that this could be a stumbling block.0 -
ppp, is your DMP with one of the free charities, or are you currently paying for this?
Might be worth looking at changing.
You can request a copy of the CCA at any time but if you stop making payment because a CCA is unenforcable, there is still a good chance that the creditor will put a default on your credit file.

I did have this problem and I did do all that was supposed to do. They just kept on sending threating letters. So in the end I rang them and asked them to please take me to court and we will deal with it there. they continued to send the letters but i ignored them. Ater about 6 months they just stopped. That was 18 month ago. I do feel guilty about this at times, as it is a debt i owe but i am in no way able to pay them at the moment. I would like to think, one day i can pay, by a one full payment ?
i got the infomation from surfing the net, before i found, this FABULOUS site.Back tracked and taking the other fork in the road, it has to lead to a better place than the other one did0
