"Write Off" your debt companies

You shouldn't have to pay someone to do that for you, people will be along to tell you how to challenge your loans yourself, for free (or a £1 postal order per loan). It isn't a scam technically as he will probably help you out a bit, but still, there is no need to pay for it.Not an expert, but I try and contribute and I'll always listen. Secondly, why pay someone £495 per loan when you can do it yourself for £1.
Yes I entered into the agreement willingly and I see what you are saying definitely, but this seemed too good to be true. In my current financial situation, it seemed to be an easy way out which, though a bit unethical, would benefit my young family which is why I want to look into it.
Secondly, I dont know the first thing about starting legal proceedings against a major institution which is why I thought about it. Maybe with a little more research I would be confident enough to go it alone.Trying to become debt free but this site makes me spend a fortune!!!

Donna - this sounds like £990 down the drain to me.
There's a small possibility your agreements are unenforceable. You could scan them, blacking out personal details, and put them on this site (or comsumeractiongroup) - if you get people saying 'yes, that looks defective' then you might want to think about taking it further.
I still wouldn't pay anything up front though.
I do have a list of 'usual suspects' and neither Northern Rock nor Halifax are on that list.0 -

Thanks fatbelly. I'll have a go at scanning them when I have access to a scanner.Trying to become debt free but this site makes me spend a fortune!!!

He said the Consumer Credit Act made certain loans pre 2007 unlawful because of the contract wording and if successful (which he states 83.5% of his cases are), he can claim all past payments back and get the loans effectively written off. Once he has decided if mine are in fact unlawful, I pay him £495 per loan and he then starts legal action on my behalf with the companies (Northern Rock and Halifax) and if he doesnt win, I get my money back. The whole process takes 6-9 months.
Donna, debts are very, very seldom written off, unenforcable maybe, but written only if you die.
9 months, where do they get that figure from? the creditor / DCA has 12+2 days to comply, if they fail, they enter default.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
"Unlawful" is utter twaddle.
Unenforceable by the creditor via the courts is possible. Not any easy option though (except for companies that charge upfront ).Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi
First time post.. my friend has told me that if I give him £295 he can get my Personal Loan checked to see if it is valid under the Consumer Credit Act he say's that prior to april 07 most loans etc can be written off. The costs are for legal eagles to audit the contract and this is refundable if the loan is uneforceable, I lose £50 if the Loan is ok
Has anyone else come across this company or it this something I can do own my own with some guidance?
Any advice would be appreciated0 -
don't give him the money0
