Conned by mobile company I want to take further action what are my options?
I took out a contract 2 weeks ago. I searched and found a good deal that claimed I could get an N95 8GB on a 2 year contract with an effective line rental of £12.50 per month. I placed an order and in an email recieved the following confirmation:
Order summary:
==========================================================================
Black Nokia N95 8GB on O2 1 £0.00
O2 600 @ £12.50/month
24-month contract
Gadget Phone Support - £2.99/month 1
PhoneCare Insurance - Band B - £7.99 1
9 months half price rental 1 £0.00
Jabra Bluetooth 2010 Drive Pack 1 £0.00
Guaranteed Next Day Citylink Service £0.00
==========================================================================
Total £0.00
==========================================================================
Now please correct me if I am mistaken but that clearly states the package i ordered is for £12.50. However when the order was dispatched i recieved another email:
Nokia Black N95 8GB on O2 1 £0.00
O2 600 + £10 Discount- 24 @ £25.00/month
24-month contract
Gadget Phone Support - £2.99/month 1
PhoneCare Insurance - Band B - £7.99 1
9 months 1/2 price 1 £0.00
Jabra Bluetooth 2010 Drive Pack 1 £0.00
Now this is totally differnet to what i ordered and what they confirmed. I have emailed them several times and i dont seem to be getting anywhere with them. They are not able to give me a logical answer instead i get the same stupid answer that only confirms the package i am on but doesnt tackle my grievience. I have written around 6 emails and I have phoned them once as well but to no avail.
My last email was to one of their supervisor and that made no difference at all. Now I am fed up and I want to take action against these guys. I am shocked and really angry with the way the mobile industry is run it is so unregulated, such a huge mess and full of lies, deception and conns. I cannot believe it happens in the uk.
Can you please advise if I can take this further?

Put the complaint in writing and snail mail it to them, preferably recorded.
Email is not traceable and before you start anything you need to show you have told them of the error.
Keep a copy of everything you send, and a log of who you talk to and when so if it went to court you have details.
You could maybe return it under the distance selling rules but if it's over 2 weeks these may have just expired. It's usually 14 days from day after dispatch.0 -
Don't worry, mobilejunkie will be along in a minute to tell you what a fool you are for taking on a redemption contract from a Carphone Warehouse subsidiary.................0

I dont think you have been conned if you are talking about mobiles .co.uk
This is a communication problem and one of not understanding the finer details of the offer, at least I hope so.
If we are talking about that company then maybe I can see where the confusion lies.
If not then please disregard all of my reply because it will not be accurate.
They have this deal : http://!!!!!!!!!!!!!!!!!!!!/black-nokia-n95-8gb.html where you get a contact which should normally be £35 for £25 pounds( and it is this £25 which they refer to in your email. It is a cashback offer and if you comply with all the terms and conditions you get half your line rental back for a predetermined number of months giving you an effective line rental of £12.50. I cant enter the links here but if you go onto their site it clearly says that the offers are independent of each other meaning that you can take advantage of both, but you do need to understand their terms and conditions and return your bills exactly on time or you will NOT get the cashback. I hope this helps and is relaevant to your problem. I have tried to copy the appropriate web pages here but i cant ( not computer savvy )0 -
for some reason the web address wont enter correctly, so just goto their webpage for the nokia n95 8gb deals0

Will (IMHO) be as much use as a chocolate teapot and just give you some leaflets.
No Trading Standards contact the TS office where the company involved REGISTERED/HEAD office is - a breach of the SALE OF GOODS ACT has happened - the item/service/contract was not sold as described.
The internet is a god-send in self education for those whom don't know law, it's not just for money saving

http://www.consumerdirect.gov.uk/
Call the Office of Fair Trading on 020 7211 8000, ask for transfer to Trading Standards, a information OFT line with choices starts, choose option 1 this allocates your call to Consumer Direct ( TS )SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... Thanks guys for your responses. First thing I am going to do, as suggested, is to send them a letter recorded delivery.
I dont want to cancel the contract I want what I ordered or I want to take legal action as to be honest I am absolutely sick of the mobile industry. Its full of conns. Its run like a third world country. Seems to be hardly any regulation and full of corruption.
Last year I took out a contract for my wife through one company called mobilerainbow. Couldnt claim any cash back when i realised from posts over here the guy that ran it is a con artist based in india.
To the guy defending them. On the search engine it came up as having an effective line rental of £12.50. Which is what it says clearly in the order summary. I tried to find it on their website recently but couldnt find it anymore seems they have taken it off.
I repeat the order confirmation confirms exactly what I am saying the deal should have been.0 -

If that website is the same one Im looking at at the moment, it has line rental of £25 pm as it used to be £35 but they gave £10 discount. Then they give 1/2 price line rental which would effectivly bring the price down the £12.50. Now if you click on the link it clearly states that this is done by redemption, which means O2 will bill you for £25, and you have to claim the cost back from the website. And I am certainly not defending the company, I'm just stating the facts from the site. You will have to claim back the amount due to you, O2 will take the full amount each month. Sorry if your not happy with that, but really as your past your 7-14 day return, you may be now stuck with the £25pm contract. You'll just need to send your bills in to get your money back. I doubt they'll do anything else.
