    The main reason chains ban shoplifters, is that if the same person gets caught again, they are trespassing as well as shoplifting. They can then be charged with burglary, which is a lot more serious.
    When I had my loft converted back into a loft, the neighbours came around and scoffed, and called me retro.

    Yep this is the reason!

    Was going to say she shouldn't have a problem in any other M&S stores (unless you have two in your area that often supply each other with staff) but will likely find if it was part of a shopping mall, retail park or high street mall she'll have trouble in other shops in the complex!

    Interestingly on a similar subject I am led to believe JD Wetherspoons bans all its ex-employees who have been fired (for whatever reason - including lateness to work etc) from all their premises.

    This is the case at my local Wetherspoons, she has been banned for six months, but only from that branch.
    Gone ... or have I?

    my daughters college friend was caught stealing several items from m and s and my daughter and another friend were with her at the time- a dare which has proved costly. Unfortunately she was stopped when leaving the store and they were all taken upstairs where the police were called. When the police arrived they issued an unofficial caution to them all claiming that because they were with her they are as guilty as she is. As this was their first offence they were informed that this would not go on record as a criminal offence and they should be very careful not to get into a similar situation again as they would have the fact that they have been cautioned on this occassion on record and would certainly charge them next time and thus creating a criminal record.
    does any one know whether it can be found by any future employer that this unofficial caution was issued.
    they have also been issued with a lifetime ban from all m and s stores and she is wondering if this was a scare tactic or whether they circulate her details to all stores. I am so worried for her she is really struggling with her a levels at the moment and hopes it is not going to affect her uni admissions. Any help would be gratefully received.

    Was she taken to the police station? If so she would have had to accept the caution, ie admitted guilt.
    If she was then it is an 'offical caution' and will be on her criminal record and she will have to declare it when making application for uni or jobs which are working with some some groups, such as care work.
    If not and the 'caution' was given in store it was just a warning by a police officer, a scare tactic which is not offical to stop her doing it again.

    The ban...stores do share names, CCTV images & patterns of behaviour with other stores. It wouldnt stop her going into other stores but she may expect to be followed. If she goes in to M&S she could be charged for breaching that ban, pretty much trespass as she has no right to be there.

    On a slightly separate note:

    kstandsteve, if you start getting letters from a company called RLP demanding stupid amounts of money, click on my sig and chek out the RLP forum there, there's plenty of help to deal with them (and like MSE, it's free) and their bullyboy tactics.

    My boy got stopped in Boots a few yrs ago, as 2 of his mates had nicked something (well, one nicked and used the other's bag to hide it) and they got caught. I got a phone call from the transport police (they were in a station) telling me about it, and telling me they'd all been banned for life from Boots, and for the doubters, she's the one who told me that my son hadn't been involved in the incident, wasn't even watching out for the others, just happened to be with them but a few shelves down doing his own thing (nothing unusual there, lol), but that he had been banned all the same just for being there with them.

    At the time, I was all set to go to town on Boots about it, since he was effectively banned simply for being with his mates, but didn't in the end and have often wondered about the legality of it all... I mean, not found guilty of anything, yet targeted... Records kept (presumably) of minors for the rest of their lives... Data Protection Act issues... etc etc...

    I find the whole "guilty by association" quite distasteful and sloppy by the stores: they can't be bothered finding out who did what, let's tar all the kids with the same brush and ban the lot. For the innocent ones, what a lesson in British justice, hey? It doesn't matter if I did it or not, I'll get blamed amyway. :(

    Just to clarify, the mere presence at a store would not constitute burglary. There would also have to be an intent to steal or cause damage.

    If it was my daughter I would ask the Police to lock her up for the afternoon to teach her a lesson. Maybe the thinking time would make her wonder who her true friends are.
